Hello,

I have agreed to settle a debt for 60% of the original amount. since February the CA has been withdrawling 44.00 monthly on the 4th of each month from my account. 6/4/08 marks the last payment on this agreement. i feel i should have a copy of this agreement before the last payment is withdrawn because the CA "Calvary Portfolio is a bit slick I have heard. I do not want them to keep taking monies from my account after 6/4. Could I maybe send a letter asking for the terms of the settlement be sent to me before 6/4 and attach the payments already withdrawn from my account of course, or should i add onto the letter that the withdrawal on 6/4/08 marks the end and completion of my payment in regard to this debt and by withdrawing the last payment they agree to this? They told me they couldn't send me such information and that after the last payment I would receive within 30 days a notice that all was well. i don't trust them. any advice.

Do you have this payment plan “agreement” in writing? Because if you do and you have your bank statements showing the withdrawals, I think your fine. If you have no written agreement then I would quickly write to them and state that the 6/4 payment shall be the last payment you agreed to and the debt will be paid in full. Send it USPS with RRR and keep a copy of the letter with the green card when you receive it back.

Thank you...I did call them. They told me i will receive it within a week, the copy of agreement...see I trusted the CA's...long before I knew they'd violate your rights in any manner possible...she said i will receive original agreement within the week..if not..then I send the check the way you mentioned above with last payment and brief description of agreement in memo area... she has a week, the payment isnt pulled til the 4th...I dont receive it in a week i'll figure something crafy out:) Thank ya for the advice

Not all CA are “crafty” . I’ve refused to work with some that just made my skin crawl Evil or Very Mad . I also have worked with a few that really made it easy as long and there is good communication. The same goes for work and life in general, things go smoothly with good communications.
