Well, we finally heard back from ameriloan this morning. They're refusing to write the loan off and are sending the total amount due to collections. Funny thing is, according to our former bank and the laws of our state, they actually owe us $60. Too bad they don't see it that way.

So I'm girding my loins, getting ready for phone calls from collectors. I'll definitely ask for a debt validation letter...any other suggestions?

I contacted our state's attorney general's office about Ameriloan on Tuesday morning--sent them all our documentation Tuesday afternoon. Hopefully they'll get back to us early next week...

Still, ugh. I halfway feel like Ameriloan is refusing to settle when the other payday lenders did because of this thread...I don't regret posting here, but I'm very very grumpy with them for making us take these extra steps. I'd even use bad words, but then the spam filter won't let me post. Believe me, I've tried...

It isn't like they could even sue you??

Ameriarses...why you being hardheaded??? Give the man 60 bucks would ya?

k-did they give any rationale? What remedies does CO law have available to unlicensed lenders with usuious interest rates???

They probably are refusing to settle because of this site. Please let us know what your Attorney General says. I would suggest getting a Lawyer and sicking them on Ameriloan. You might be able to find a low cost attorney through Legal Aid. Otherwise I wold be tempted to let this go to court (assuming they are stupid enough to let it go that far), and see look on their faces when you present your case to the judge outlining their violation of State laws. I suspect they will not take this to court and try only to harass you, in which case I would obtain a legal order barring them (their agents and assigns) from contacting you, or your could take THEM to court and sue them asking to have the account declared paid by the court..

You say they are not licenced in any state? I live in Arizona and have a loan with them - I think oneclickcash is also ameriloan which is rio resources is it not?

They're all part of Rio Resources. You can search the forum and find all the addresses. Use the google search on here or search the bbb.org site and you will find addresses there. The addresses are here in a bunch of places.

So ameriloan is part of Rio Resources?? Interesting...and my thought is that they would get their royal u-know-what's kicked out of court for trying to intimidate their customers over what web sites they go to! Can you say Freedom of Speech violation??????? It just goes to show that this website is doing its job, cause it's such a threat to the PDL companies....

that depends on if they are licensed in your state, if you did it at a storefront, or online, and exactly what they are saying to you. We'll need more details than a number and asking if they are legit.

I was just wondering how you find out what your paticular states regulations are. Where do I look! If my state is anything like the states I have been hearing about I have and are still being ripped off.

look ameriloan has rolled over on me for 5 month every two weeks. At 105.00 everytime. So I put a stop payment on them. But then they called my bank and said that I said it was ok for them to take an additional 505.00. Im sooooo pissed. Why would I pay 35$ for a stop payment if I was just going to turn around and tell them that they could take 505.00.
Oh and by the way, my original loan was for 200.00.
I dont know what to do...my bank called the # on the check and the lady on the other end said that she would talk to customer service. When asked to speak to customer service, I was told that they were not in the same location and that she didnt have cs's #. How stupid is that. So know my bank is considering giving me back my money. But what if they dont? Thats money to feed my child with. I swear if I knew where they were......I'll just leave that unsaid.

aba, wait a minute. Ameriloan1 called your bank and said it was okay to take out over $500? Am I reading this correctly? ameriloan called your bank? And your bank debited your account for this money and gave it to them? If I am reading this correctly, something is terribly wrong here. First of all, Ameriloan is an unlicensed/illegal company. Second, what do you mean they called your bank and said it was "okay" to take money out? You're the only one who can "okay" money to be taken out. Not some company. Third, your bank has made a SERIOUS error if this is indeed what happened. They can not just take money out of your account because "someone" calls and says you said it was okay. That would be like me calling your bank and saying "aba said it was okay to give me $600 out of their account". What????? Major, major problem here, aba. You need to get into that bank ASAP and get that debit reversed back off. And, if indeed they did do this at the request of an unlicensed/illegal company, you need to file complaints big time!
