MTE Financial response to BBB

PostPosted: Thu Jun 28, 2007 10:53 am Subject: MTE Financial response to BBB

BBB contacted me via email regarding my complaint about MTE. MTE has denied they are affiliated with One Click Cash or US Fast Cash. MTE claimed they made a reasonable offer of settlement with me regarding one loan (quickest cash advance). I then received an email from MTE with a REVISED settlement for the loan with a HIGHER amount. BBB wants me to respond to them by July 8th. MTE wants me to contact them regarding payment of now $267.50 instead of the $177.50 they originally stated. Okay. What am I to do? MTE is lying, of course. MTE has now up'd my amount due in a matter of three days. The BBB wants a response to me. This is getting totally insane.

Here is my response from the BBB from MTE financial:

Quote:
We have reviewed the account belonging to debtfreein08. We believe all the terms and conditions of this loan have been met on our end, unfortunately debtfreein08 defaulted on her loan agreement and refused to repay her debt. Her account has been referred to an outside collection agency for handling. We no longer have any control over the account. We will consider this matter closed unless we hear from you.

Thank you for your time and consideration in this matter.

So, what do I do now? File an agreement against ARM-The outside collection agency?

Good question. Their response to the BBB ended with the exact same wording as the above forum user's response. They consider this matter resolved until they hear back from the BBB. Only difference is they stated that they made me a reasonable offer. Next is going to be them turning it over to collections because I don't find their offer reasonable and I'm going to fight it. So what's up? They are now wanting almost $500 on a $300 loan. The BBB, to me, is actually no help. MTE just lies to them, then sends insane emails to me. What is the next step? Obviously the BBB is going to get us nowhere.

Is that the first or the second response from the BBB? They usually let you respond twice.

I'd file against both places . . . . That way you have both bases covered.

This is my first response from the BBB. I filed against ARM, too. Haven't heard anything from that yet. Should I file against ARM with the State of Florida?

I mean, what if ARM comes back and shows how they legally calculated the debt? I am so freaking out and worried!

This was my first response from the BBB. They gave me until July 8th to respond to MTE response. I will respond - through the BBB. I will respond to MTE themselves - via email that they sent me wanting more money. So, once we "respond" to the BBB and they will then "relay" our message to MTE, then what? They're going to say it's un-resolved because we couldn't come to a mutual agreement. So is this a dead end???

This is what I said to the BBB:

Quote:
This is not true. I have not refused to pay my debt with them, if they can legally show me how they calculated what I owe them and how they calcuated it, I would be more than happy to pay them what I owe. Also, I would appreciate it if you would not publish my cell phone number to them, as I have sent them a cease and desist letter not to contact me at my work or on my cell phone. Do I then need to file a compliant against the collections agency? As they are stating that I owe them money, but have not legally presented a letter to me showing how they validated the debt according to my rights under the fdcpa. Please advise.

This is what the BBB said to that:

Quote:
I apologize for given them your cell phone number, but we are required to forward any and all information provided to us by the consumer. By using your cell phone number as a contact number, it was given to them. You may wish to file and additional complaint against the collection agency. That is your right. I will forward this information to them for their rebuttal response.

You need to have the contract from MTE that proves them as legit. It should have all the loan terms mentioned in your state laws and the collection fees when the account reaches in default. Any CA collecting on your account should be able to validate the debt with the following information. If there is no paper proof, you are not liable to pay anything. Just stick to your rights and demand documentation from the companies you are dealing with. Make sure that you do all the communication in writing through CMRRR. You need to have enough proof when disputing the charges with the pdl and the CA.

a neblat,

Thanks. From what I hear, ARM doesn't have a leg to stand on, because they can't legally prove the debt or documentation to show it. And, as I understand it, if they don't respond to my letter within 30 days, I do not have to pay it. Correct?

I will put in a better way. If I had been in your situation, I will not pay to someone who has not yet proven their authorization to collect on the account. Since ARM is not able to show any documents with the legal terms, I will not send them a dime.

Cannr, Do not I repeat Do Not get so upset about the BBB. In your state the BBB is not who you want. I got several e-mails from the BBB on MTE and they all were similar to this except mine was signed by Sabrina Collins. The internet ones are not legal there plain and simple. Even if they turn it over to collections they are going to be hanging thereselves also. The AG here is going after collection agencys that have tortured people on these payday loans. If they do that they are as responsbile as a payday company. They would be collecting on an illegal debt. Hope this helps. KYSIDE38

Oh, this is typical of MTE. How do they get that you owe them more money? Didn't you calculate that you owe them a smaller amount per your state laws? If so, then this is what you need to stick to. I would put that in your response to the BBB. I got to the point where I just filed with the BBB so the complaint would be on file against the company. I got the most response from the AG or DIF in my state. Also, they lied in their reply to the BBB as far as my complaint went. They even quoted some of the things I said on the forum. I had a different name them. Now, I am seeking other goverment help against this company. I'm tired of their lies and games. You are in the right here, just remember that. Try not to get upset over this. Smile

This must be a day for the BBB...I also got a email from them with the response from MTE. Same thing...they believe they have met their obligation but are willing to let me just pay the principle of the original loan of $300....this after I have already given them $830. I also must respond by a certain date...however they also said they had sent me an email with the new terms which I have not recieved.
