I need a little help on how to deal with a loan that my husband received from Instant Cash Loan Till Payday (one of Rio Resources dba). He received a $300.00 loan from them. We were paying extension fees every week, we paid a total of $630.00 in interest and $200.00 in principal on this loan. I ended up closing my checking account, due to all of my payday loans. I contacted them informing them of my account closure and asked for alternate methods to pay the balance. Then, after reading about Polly's letter, I sent them via email and fax several letters requesting to be marked Paid in Full, and also requesting a refund of the overpaid interest. They never responded back to me in either case, until, of course they had already sent the $100.00 principal they still show due out to a collection agency. I have filed complaints against them with the BBB (complaint closed after response from Rio), my state Attorney General's office, the FTC & IC3 websites. Today, I get a call from United Legal Services asking me to pay $130.00 to clear this account. I am just not sure what my next step should be, I have already paid $830.00 on this $300.00 loan. And I also don't feel that an extra $30.00 fee should be added on to the amount when I contacted them originally asking for alternate payment methods. The funny thing here is that I also had another loan with Rio Resources in my name, and they sent me the requested refund!

Ask United Legal to verify the debt and I bet it will go away. Keep sending your letter to them and don't pay anything. You've done a great job so far, don't give up the fight yet.

I thought asking them to verify the debt would be my first step, just wanted someone else's opinion. Thanks Sue for your help. I am so glad that I found this forum, I went from having seven payday loans that I was only paying extension fees on every pay period, to only having 2 now that have not marked my account paid in full (of course, I had paid WELL over what I should have on all of them). Rio Resources for this loan, and then my favorite one of all, Nationwide Cash/Ambassador Collection. They are a real joy to work with! And I even received the one refund of $585.00. It has been such a relief to get these taken care of.

Okay, so does anyone have the contact information for United Legal Services? All I have is the phone number 866-679-4046. I'm pretty sure that they would be less than willing to give me that information themselves.

Also, when I was talking to the lady at United Legal Services, I asked her why the balance they had was $130.00. She said that Instant Cash Loan Till Payday had added $30.00 as a fee for the returned debit. I told her that they had been contacted and told that my account was closed and that I requested alternate payment methods. She said "well, they do that so that they can make more money on your account"! Funny that she would actually admit that to me. Oh, and she also offered me a settlement of $98.00 on the account. Yeah sure, I will settle with you for $98.00 dollars, on a $300.00 loan that I have already paid $830.00 on.

You're doing all the right things so far as I can tell. I wouldn't call United Legal again and I would definitely keep sending the letter.

Be careful while you are working with United legal. They already have a lot of negative feedbacks. Check this thread.

United Legal Services has not validated your debt in writing yet. Make sure that they are authorized for this collection before sending any money. You have already paid so much money towards the account. Now your next move should be to claim for a refund rather than settling for anything more.
