Anyone still dealing with GFSIL? I believe I have found the way to finally get them off your back.
First off some background: I received a $200 PDL from them in early December. I paid them well over $500 and then it got so bad that one of their checks bouced my bank and from that moment it was a free-for-all. They tried processing multiple payments of different denominations using different names until I was forced to close my account $800+ in the negative. They threatened me at work, spoke to my co-workers, left harassing voice mails. This is when I started recording my conversations with them. I have copies of the "we will file for wage garnishment" and "you missed your payment and we will call your boss and tell him all about your illegal fraud practices" voicemails. As for the live recordings, I ask not to be called at work beacuse my employer doesnt allow personal calls(at first he said I will call you wherever and whenever I want until you pay, then on a call later that day he said he would block my work number...only to unblock it two weeks later.) I also have them refusing to send me any paperwork, as well as saying they dont have to be licensed in my state or follow any federal or state laws. I took the advice of the forum and also branched out a little and here are my results:
1.) Filed a complaint with the BBB of Indiana. I received an email back saying they have made numerous attempts to contact GFSIL but received no reply (and went on to say how that would just give them a bad report in the BBB database.
2.) Contated the Indiana Attorney General. The guy I spoke with told me he could not help me beacuse it was an internet company and that he had never heard of such a business as internet PDL's(you would think if someone is doing illegal/unlicensed business in a state whether online or not, the AG would have a small problem with that). The only thing he did was refer me to the FTC...which brings me to my next section.
3.) Filed a complaint with the FTC. The woman I spoke with told me she couldn't help me and that I would need to contact the Indiana AG (you can imagine my frustration at this point). I did call the AG back but he gave me the same runaround.
By this point, GFSIL told me if I did not pay them another $300 on my next payday they would put me on an auto-system where I would be called at work every hour, and if I hung up, they would repeatedly call back. Here's where I started making progress:
4.) Filed formal complaints with the Nevada Division of Financial Institutions in Carson City as well as Reno/Las Vegas(can't remember which city it was). I faxed them my bank statemnt, the links to the audio recordings I have with the company, as well as copies of all complaints filed.
About 4+ weeks have passed without a phone call. I followed up with the DFI in Nevada and they told me the case had been forwarded to the Nevada AG. I then spoke with the person dealing specifically with GFSIL and he couldnt go into much detail beacuse there is an open, ongoing investigation, but I did find out it was forwarded to their office because of so many complaints filed. He said that the Reno address isnt even a call center, it is strictly a mail drop and they work only out of the UK which leaves some loopholes. Thankfully those loopholes are getting smaller by the day.
Monday, I filed(or rather my lawyer) a small claims suit against GFSIL involving their illegal practice, illegal collection methods, and some other lawyer talk that went over my head. Seeing as how their not licensed in my state, there is no question I will win my suit the second it goes before the judge. Then the tables will turn on who owe's who!
I am paying off my last storefront PDL today to Check Into Cash(which by the way has been great, they gave me three extra pay periods to take care of it instead of taking me to court or sending me to a collections agency.
