Laverne, go to www.ilga.gov and look up (740 ILCS 170/) Illinois Wage Assignment Act ... there is a defense form you can fill out under section 4.1.

The notice shall be by affidavit and shall be in substantially the following form:
Quote:
"I, ...., hereby (swear) (affirm) that I have a bona fide defense to the claim of ...., which claim is based on a debt contracted on (insert date), and for security on which debt a wage assignment was executed.
..............................
Address for service of summons
..............................
Employee
Subscribed and sworn to before me on (insert date).
............................."
Notary Public
Fill out the form and give it to your payroll. If your payroll still honors the wage assignment, you can sue your job.

Laverne..I am an HR rep, and trust me, the letter above will take care of it. As of 1986, you can revoke a wage assignment..A good HR or payroll rep will know that.

You know what else works Laverne..You can simply say as of this date I do not authorize any and all voluntary deductions, including wage assignments. If you already have voluntary deductions, such as 401k or profit sharing, make sure you state you DO NOT want those eliminated. It doesn't have to be fancy..It's your right to revoke it.

Assuming you revoked your wage assignment, your revocation is a defense against the wage assignment.

Simply fill in the blanks:

You will need to have a notary fill out the bottom, sign it, and put their notary stamp on it. If you don't know a notary, most currency exchanges have a notary and will do it for $1.00

i printed ti ilcs which should i send to the payroll there were many of them

You don't actually need to give the ILCS to the payroll; that is just the laws regarding the wage assignments. But if your payroll does not know what the law is, you might give them a copy to refresh their memory.

The defense form I posted above can be used if they already sent a wage assignment; if they did not send a wage assignment yet, then use Finsfans suggestion to cease all voluntary deductions.

so i just write the letter above and send it to the hr department and they are not supose to let my money be waged from my check. this will give me time to get in touch with them and get the settlement letters out and make payment arrngements. and pay the other bills at the same time, is that right?

I remember in one of your posts that you said you get paid again on Dec 8. Well, that's this Fri so you better hurry along and show that letter to your HR and PAYROLL DEPT. if you want to stop the money from coming out of your check.

where it says adress i put my address there right, where it say employee is that the place i work at right. thanks so much i will do this now and give it to the office tomorrow the one i gave them wasnt good but this one will cover that one thanks.

Laverne, I'm sorry, but if they already got the wage assignment it may be too late. I post payroll and checks get cut 4 days before the employees get their checks.

Your right Fins!! I get paid biweekly on Fridays and my employer runs the payroll on Tuesday evenings.

If your payroll has already been done for this check, maybe your payroll dept can tell you if any type of wage assignments went through for this pay period.

the other people have not tried to get the money out yet so that dont know they are being rejected yet so i may have a chance but i will call them i write a letter already. but theis one is more formal.

how much can they get it for if they do i did send a letter of revokment but iam just sending these things to be on the safe side, also the are supose to tell me if the got one dont they or they just let them have it without telling me.

because do you think they have did it they called me today i just didnt talk to them so do you think they may have done it our payroll does not goe in till the week fo pay period because we have a certain day to get the time cards together. i wont say because i do not know who is looking. here.
