State investigates debt payment company

PRATTVILLE -- The Alabama Securities Commission and the attorney general's office are investigating a debt payment company based in Prattville for alleged deceptive trade practices and operating without the proper license.

A civil complaint against Allegro Law LLC, Allegro Financial Services LLC and owner Keith Anderson Nelms was filed in Autauga County Circuit Court last week. Nelms is an attorney who has a law office in Prattville. He faces no criminal charges.

Circuit Judge Ben Fuller froze the as sets of the companies and Nelms' personal bank accounts last week, on the request of the state agencies.

Fuller heard more than five hours of testimony in a hearing Thursday afternoon and likely will decide today if all the assets will remain frozen.

The Securities Commission asserts that Nelms has to be licensed under that agency to handle debt payment activities in the state. Nelms' position is that the Alabama State Bar is the only agency that has the jurisdiction to license attorneys in the state, and the Securities Commission's license isn't necessary.

Nelms is dissolving Allegro Law LLC and attempting to form Allegro Financial LLC, another debt payment company, as its replacement, said his wife, Jennifer Jordan, who is also an attorney and is representing her husband in the matter.

"We applied for a license from the Securities Commission for Allegro Financial, but the process has been halted because of this complaint filed against us," she said. Nelms operated Allegro Law LLC out of his Cobbs Ford Road office in Prattville, the complaint states.

The Securities Commission and the attorney general's office say Allegro Law's clients include more than 15,000 people nationwide and "at least 175 Alabama citizens."

Nelms ran afoul of the Deceptive Trade Practices Act in dealing with his clients, the complaint alleges.

Customers of the business "do not understand how much they are charged in fees by Allegro and do not realize that no payments will be made to the creditors by Allegro until those fees are paid in full," the complaint reads. The complaint continues with "Allegro customers do not understand that they will pay a $25 non-legal set-up fee, a $59 monthly fee and a fee of 16 percent of their total debt enrolled in the program up front, before any payments are made to the creditors by Allegro Law." According to Jordan, customers were informed of how the debt payment plan works through several sources, including phone calls, letters and a contract they are required to sign before entering the program.

Customers would pay Allegro Law a certain amount each month, and the company would negotiate with creditors on their debt. The money would go into an escrow account until enough funds were accumulated to pay the creditors.

"The attorney general's office is basically saying that Allegro Law isn't a viable business," Nelms said after the hearing. "We performed valuable services for our customers. Many of their accounts were settled for half to 30 percent of what their original debt load was. I say that's a very valuable service for our customers."

In a matter unrelated to the civil complaint, Nelms has agreed to a three-year suspension of his license to practice law in the wake of a complaint filed against him by Chase Financial in New York, based on the activities of Allegro Law. He entered the conditional guilty plea before the Alabama State Bar's disciplinary board June 29, records at the bar show. The board is responsible for regulating actions of attorneys licensed to practice in the state. The Alabama Supreme Court accepted the plea Thursday morning, court documents show.

The suspension goes into effect after the high court's acceptance of the plea, said Jeremy McIntire, assistant general counsel of the Alabama State Bar.

The plea states that Nelms represented himself as an attorney to customers in the debt payment business but is only licensed to practice law in the state of Alabama. The plea also states that Nelms took the 16 percent fee up front, before doing any work on behalf of his customers. Lawyers in Alabama can't accept fees unless they do something to earn them, McIntire said.

Nelms also owns two Steak-Out restaurant franchises in the tri-county area. He was an unsuccessful candidate for the District 7 Montgomery City Council seat in 2003.

The accounts for the restaurants and his law firm also have been frozen. Fuller said he wants to release those accounts as soon as possible, if it is proved that there is no co-mingling of money with the debt payment company accounts. Fuller appointed a receiver to handle the frozen accounts.

"The restaurants and law office have employees who rely on those businesses for a paycheck so they can pay their bills and feed their families," Fuller said at the end of the hearing Thursday. "My position is we need to get the auditing of those accounts completed as quickly as possible, so we can have an absolute minimum impact on the folks who rely on these businesses for their livelihood."

This is all I could find on this. I looked yesterday for Keith Anderson Nelms name in the Alabama Bar association site. His name was there. TODAY it is not there anymore.

I spoke to the receiver's office today and was advised to go to Allegrolawclaims.com and scroll down to the bottom find the claims botton and fill out a claim's form and submit it as soon as possible. This form with be sent to the receiver's office. Who is in the prossess of reviewing and determining who and how much the clients of Allegro will be getting. So go to the website, fill out the form and good luck. The secretary also mentioned that they were having trouble with the sent botton, if you don't see one, she said to keep trying, don't give up.

just found out that the only way to file a claim with allegrolawcalims.com is to go to the website and click on contact us and submit your claim. There is no claims form or send botton on the bottom of the site. Also, you can get all the up to date infromation regarding the proceedings.

I went into the 1st American Debt Relief program with Allegro Law Firm over a year ago. It is a NIGHTMARE!!!!!
They took over $6500.00 in fees up front, which I found out is illegal. They have only settled 3 small credit cards. My wages are being garnished with creditors that were supposed to be in my program. Allegro has a law suit against them now with the attorney general, including unlawful acts against citizens. I am trying now to get out of this program. Good luck!

I really sided up for dept conseling with Allegro law in May09 and they have only made one payment on my credit cards for me. They made my first months payment to my credit cards and the second month, they are subpose to electronicly take out the money from my bank account on the 5th of the month. Well around the 9th they still had not takin the money out of my account so I called and they told me they were under investigation so they weren't making any payments for their clients at this time. They had no clue when they would be able to take things back over. Then the third month, they did take the money out of my accout, but have no made any of my credit card payment and its about time to pay then again. I feel so much more stress being signed up for this program, then I did before! I wouldn't recemend them to anybody!

Was just informed by the receiver in Prattville Alabama that was appointed by the Alabama Attorney General to take over the
Allegro Law that there will be 2 web sites that will need to be
visited and have your complaint logged. The first one is by the
receiver that is up "allegrolawclaims.com" and there will
be one up soon by the Alabama Court System. Was informed by
the receiver to monitor theirs first to look for the link for the court. Allegro Law is still in litigation until the end of August so keep monitoring this site and the receivers site because it will
be necessary for all parties involved to register on both sites.

We used Allegro for Debt Management, They renegotiated
our interest rates. We were very happy until the 3rd month when they did not pay any of to debtors. I have tried and tried to get in touch with them with no luck.

DON'T DO IT! Particularly if you're big on customer service or talking to an associate about your account. I can never get ahold of a person. You will be on hold forever and probably not talk to a person.

Anyone that has questions on settlement or debt mangagement needs to research both programs. Many do not realize the damage they are doing to their credit reports by taking the settlement route and can not recover from that decision for years and years to come IF EVER...

The most unbiast advise you'er going to get is from the creditors themselves and would they would be happy to offer their oppinion to help guide you. I can tell you this much, if you have everything you want in life home, car, good paying job and you don't need to rely on your credit score any longer than settle your debt but if you need that good credit score to open new charge cards refinance your home or buy a home and expect to get a anywhere using you credit score and "Settlement" appears on that report or you can forget about it... You're no longer a good risk.

I'm very concerned. Waited on hold for 35 minutes to talk to someone that i find out is only a rep from their processing center, (whatever that is). I currently have 2 summonses against me. When i asked what the status of these summonses were with my creditors, the rep could provide me with no info. lack of info from them is very frustrating!

If i have to find my own lawyer to battle these summons' then what am i paying Allegro for?



Now i find out that there's an action against them, and everything is basically on hold. Funny, they're still taking my $ though. I stopped this months payment and am ready to ask for my $ back. Not even sure if i can get it back from what i read. Starting to feel sorry i ever went with this program. please read updates at allegrolawrecievership.com

I believe I just got scamed by Allegro Law. On August 25th I sent in a payment. The monies have not been dispursed. I cannot contact Allegro Law.
At first it was working perfect. They were working back and forth with my creditors. My first payment was dispursed among them. However, now they seem to have disapered

I am going throught the samething. I dicided to stop payment with my bank and cut my losses. I know it's frustating but allegro law cares about know one but their selfish needs. They tried to take more money from my bank account but I put a stop payment. They will not complain because they know their wrong. I read the papers so I know what going on. if you keep pushing for them to take out money, they will. All their assets are frozzen. so they will take any money they can get. you all must put your foot down and stop this madness. Any money you give them will just deeper in debt. We must stick together.

DO NOT GO WITH ALLEGRO LAW FIRM!!!! I repeat DO NOT! They are being sued by the state that they are in (ALABAMA) and have been taking money from thousands of people and NOT settling their debts. I am now a year behind on my credit cards and Allegro Law has done nothing the whole year that I have been with them except take 200.00 a month from me. Look them up on line and read all about what a fraud they are.
