Hi, I am new here and like alot of you in trouble with credit card debt and hospital bills. I am being sued by Capital One in small claims, ($990.00) now and fear that more is to come. I spoke with an attorney before and they did not think the smaller companies would sue because it would not be worth their time and to just ignore them. Not anymore. They are the aggressive ones because now it appears they are going through the district Court system to get their money, or shall I say the third party who "bought" the debt and are using the original creditors name. Can someone steer me to a good debt settlement company? Perhaps Kentucky area?

Kentucky is one of those states that has banned debt settlement. The only companies that can legally offer settlement in that state would be a law firm in the state of Kentucky.

Did they ban all debt settlement or did they just ban companies that hold client funds in trust? Most states that have laws regulating debt settlement only apply them to companies that are holding their clients' money.

I wish that was the case but they banned settlement all together weather they hold the funds in a trust or have you self save the funds. It must a lawyer in KY to be able to settle in that state.

Does anyone know of an attorney that would handle a debt settlement? Several years back there was one in Lexington, but I haven't seen any ads or anything pertaining to this. Only Bankruptcy and debt consolidation. I have tried the consolidation company and they wanted a huge payment every month plus could not guarantee me that they credit card companies would go along with it.

I know Oak View Law is a law firm but I am not sure if they are a network of attorneys and have a lawyer in KY or not to be able to work that state.

I live in Kentucky. I don't know if they are legally operating in Kentucky or not but I here ads on the radio and see ads on the TV here quite often for various settlement companies. I don't know any of them off the top of my head since I never looked into it but I know they at least ad here. You might consider investigating the non-profit ones and see if they are legal and operating here.
I suspect if you paid a lawyer a decent wage then you could easily get one of them to do it for you. I had a lawyer in Lousiville settle a claim I had in 2001 with an old apartment at around 70% of what they wanted. It cost me $100 plus the settlement amount but the apartment never sent anything in writing. I ended up settling the debt myself for about 40% around 6 months later but I think the letter from lawyer helped. His name is Troy DeMuth and his current website is below.
