my mother died in july 2007; she was under my sisters care, as she had the power of attorney for my mom...
my sister says that even though my mom died we have to repay the costs; 2 or 3 expensive brain surgeries were performed on my mother at my sister request. This was not the way I would have taken care of my mom, who should have died in peace...not in pain and misery.
What is going on here??????????

Your mother’s estate would be responsible for all outstanding debt. Neither you nor your sister would be personally liable for any of your mother’s debt even if your sister held POA. Settling estates especially if there are a number of assets can be complicated and I am certainly no expert. I know it can be done without an attorney even if there is a lot of assets since my great aunt did it for my other great aunt and great uncle. I do not know their exact net worth but I am guessing at least 1 million each. I also know she spent a lot of time dealing with both of them that she would not have spent if she hired a lawyer but it saved her a lot of money doing it on her own. If there are no assets then the creditors are pretty much out of luck but you need to file the proper paperwork with the death certificate.

If you are unsure about what you should do you need to consult with an attorney that handles estates. It can be very confusing in dealing with all of the legal aspects of an estate. What state are you in? Did she leave a will?
There should be an attorney in your local area that could give you a free legal consultation. If not contact your legal aide office who can assist you.

You should consult an attorney and quick. If your mother had an estate and you aren't equipped to deal with all of that, you will end up in a bigger mess. There are very legal and illegal ways of dealing with things like this and it will be worth your time and money to get the proper help.
