Mann Bracken LLP calling me to pay back a debt. What to do?

I was being sued by citifinance and agreed with mann brackrn to pay payments untill balance was cleared. I recieved a statement last month and as of 1/14/09 i owe more now then when i started the contract . how do the right to charge a intrest fee of almost $900. they are not a bank. they are only adebt collector. what are my rights?

I am being hounded by Mann Bracken, just authorized a payment today to get them off my back. The terrible thing is that I was late on a payment to GE, and then quickly paid GE the past due, current due and the next month's due "Just in case" and the person at GE told me that I was lucky to have made the payment because my file was ABOUT to be sent to collections, but that I was now current and up to date.
But, somehow someone didn't take my file out of the ones going to Mann Bracken. After months of running between them and GE (they said GE had to recall the debt, GE said Mann Bracken just had to send it back), Mann Bracken finally said that it was too late to do that, I was in the "Hot zone" and about to be sent to legal. I buckled under fear of lawsuit/judgement. I was paying GE $70/month. Mann Bracken is insisting on $400/month. Horrible. And the worst part is: yes, I was late almost 60 days, but GE accepted my payment in full, I was current, and they told me I was NOT in chargeoff or collections status. *Sigh* |

Some information this is not legal advice but opinion. I am a former Sheriff's Deputy when they file suit on you. As a rule anyone who does you are notified by summons which is served by the Sheriffs Office or process server. Once you are served you then as a rule have a period of time to file a answer. This may be different but as a rule in most I believe it to be 30 days. I suggest the follow my opinion only. File the answer on the last business day from service.. My opinion only not legal advise. Once you file a answer I would file for them to provide info on the date that several others listed. If they can't do so, then you can file a motion Rule NiSi which means the dismiss the case.
But simply them saying they served you, is not that simple. Some states are different. But best advise call the court and ask them to verify the case number.. Hope this helps! |

How do you make them validate a debt? I offered a payment amount and set up automatic payments out of my new checking account.( thankfully I set up a new account just for this so they can't get into my other accounts) I have called and called them since and can not get through, so I left messages. I've asked them for a settlement form proving that I have indeed settled with them. So far they have not contacted me. I guess they will when they try to get the money and it's not there.

The beginning of the week i received a letter from Mann Bracken LLP, stating that it was "notice of intent to sue". I called on monday and was constantly transferred from one person to another for at least 30 minutes. The samething on tuesday. On wednesday i finally got through to someone. She told me i had a few options 1) settlement (which i cant afford) 2) at least 450 then 200 every month after that til its paid 3) they would take me to court an garnish my wages. i am scared as heck. I live with my family, nothing is in my name. The lady has called me 3-5 times everyday since i talked to her. Can they garnish my wages? Can they sue me? What do i do? Should i be worried? Im so scared.

since they haven't filed suite yet.get a debt validation letter out asap.send it certified mail return receipt.send it out today or tomorrow.once they sign for that they can't legally do a thing including sue until they validate.you ca find an example letter in the DYI section.

I owe money to GE and im willing to pay it. They are only willing to give me those three options. I rather go back to them and continue to pay them. With Mann Bracken its like a run around. So Mann Bracken can sue for an unsecured debt? What exactly can they do? Will i have to go to court? A debt validation letter example can be found in the DYI section of what? I have never been in this situation before. I have a friend who has given me advice because she use to work with a collection agency. Im scared i have kids and a single mother. An i think of so many things when the word "sue" is in my head. An im really worried about this. Like i said im willing to pay it. I dont even bring home $1000.00 a month not even half of that. I live with my parents.

I have been asking this company to send me validation letter stating that I owe them money, but no answers from them when i call they just keep making threats without listing to me. Now i have recieved letter from my bank stating that Mann bracken has sent levy and their going to withdraw $1913.00 from my account on April 30th. What could I do to stop this from happening. I barely have enough money to pay my bills. What could I do I need help

That's what I would do. Remove your funds and close the account (open a new one in another bank first). You should also send that DV letter to the Credit Reporting Agencies. If there is a Judgment (which is likely) and you don't know about it you could vacate it for improper service, so no worries there. But the 30th is only in 3 days and that gives you no time.
