Mann Bracken can sue you
Mann Bracken can sue you. They represented Citicards when I was 7 months behind on payments. It was legit. The summons is listed on the county's court website, the sheriff served me, and rather than going to court, we reached a Consent Judgment which was signed by me, a judge, and Mann Bracken's attorneys. I also thought they were trying to intimidate me and many others told me I wouldn't get sued buy I did. Be careful and consult a lawyer. Whether they're scamming you or not, protect yourself and save yourself from all the stress.

That is unfortunate that someone told you that you couldn't get sued....
The problem against Mann Bracken is that they don't respect Federal Law (the FDCPA) and act like boorish "hall-monitor" children. It's obvious they can sue, they hand out summons like it was Halloween candy. By the way, a consent Judgment is still a Judgment. My big question is how could you not afford to pay your bills on time but you can afford to pay on a judgment. Speaking of stress... Miss a payment and they swiftly garnish your wages (unless you are lucky enough to live in a state where they can't do that). |

Once you get a judgment against you there is not much you can do except pay it or they will garnish your wages, depending on your state. Also depending on your state, an unpaid judgment could sit on your credit report for up to 20 years, plus get up to 20% interest rate applied to it!
In other words you have 2 options: pay it, or file bankruptcy. If you can't pay it, you should have already file bankruptcy. |

Mann Bracken LLC
I have been served with a summons to court on 7/7 by Mann Bracken LLC and called and spoke with this lady and tried to explain my situation she told me to do hardship I would have to come up with 800 today and 200 every month after for 3000. The original debt is only 2500. I also spoke with the attorney listed and he offered me 100 a month for the whole 4400 and said no other fees would be added. Should I go with that just to stay out of court?

If you accept it, and you get it *in writing*, then sure, why not? It's always good to avoid a judgment if at all possible.

Mann Bracken/capital One
I had an account with Capital One. 4 years ago Capital One sent me a letter stating the account has been paid in full. Now they have hired Mann Bracken to go after me. They have even filed papers in court. I can't understand how a creditor can send you a letter and say its paid in full and 4 years later come after me.

If he gives them your phone number, then they can no longer call him. But they will keep calling him if they have reason to believe that he *does* have your contact info. Another way to stop it is for him to tell them to Cease & Desist calling, and then follow that up with a letter.

Mann Bracken
I have been getting calls from them. I tried to work with them to pay off a past debt of my husbands'. They aren't willing to work with me at all. They had me promise to pay more money a month than what I and my husband bring home in a month. I don't know what they are trying to do. I'm going to call them back tomorrow and change the amount that I will pay back and lower the payment.
It's funny, I have never received a letter from them stating that I owe them money. Am I doing the right thing? Help please |

First thing you need to do is send them a DV letter by CMRRR, making them prove that they own the debt and have the right to collect it. Secondly if you do agree to pay them, make sure they put the agreement in writing on their letterhead and signed by a manager. DON'T GIVE THEM you bank information. They will empty your bank account.

I have a old credit card that I stoped paying in the amount of $2500 through chase. MannBrakken sent me a letter with the intent to sue a couple days ago. I have read several things on this site that say they are crooks and the debt will never go away with them. I want to start paying this debt. Can I pay chase, a debt consolidation company or is mannbrakken my only choice?
