Go into bankruptcy court and file a pro se 13 case, costs about $300.00. Once you file, it will automatically stop the foreclosure as the case will be pending.
You may be correct that you can't
succesfully complete another 13 since you are 3 years out of your last one -- but you don't need to complete it, you just want to buy some time. Once you file, it will take the trustee about 2-3 months to realize you were just out of a bankruptcy. He then needs to file his objections to your case and he will motion the court to dismiss the bankruptcy. By the time a judge dismisses your cases, it might be 3-4 months after you file. For that 3-4 months while the case is pending, your mortgage is under a stay of collection from initiating any foreclosures; and by the time it gets dismissed, hopefully you've saved up enough to bring your mortgage current.
