After reading more postings, it seems there are a lot of similarities between USFastCash and UnitedCashLoans. Are they the same company operating under separate names? Anyone have any experiences that would attest to this theory?

They are the same company. These two plus ameriloan, 500FastCash and One Click Cash are all just "brands" owned by CLK Management out of Overland Park, KS. If you're having problems with them, you should report them to the Kansas Department of Financial Institutions as well as your own state AG. Their loans aren't even legal in Kansas.

They have a deal with the Miami Tribe of Eastern Oklahoma. The address is nothing more than a fictitious office in a tribe-owned building in Miami, OK. The tribe gets a piece of each loan, CLK claims the tribe is the 'real' lender and when the AG's come knocking they argue that tribes cannot be regulated by the states unless Congress gives the state the authority. More often than not the state AG decides it isn't worth the time, money and effort to prove them wrong in court.
But AG's are politicians, too. If enough people (read: voters) put the pressure on, they might revisit their priorities.

Uh huh, thanks FreakyFriday! I feel another email in the making! Think I'll send one to "both" companies making them aware that I know of their attempts at slipping through this "tribe" loophole! And, illegal even in their own state? Okay, this is just TOO good...I have to go type!

Yes, they are the same company. I've dealt with both of them so feel free to ask any questions. They even contacted me on one phone call for collections on both loans. They are part of the MTE/Rio family.

Honestly, they still claim I owe them both money. The reality of the situation is that they owe me money. They responded to complaints that I filed against them but they lied. They are liars so let me warn you! They turned me over to collections but the debts were never validated. They have been quiet for a long time so it's kind of in limbo now.

Thanks, Mishele, that's going to be my tactic when they send me to collections as well...send a debt validation letter and not hold my breath!
I had two prior loans with United and USFastCash and paid them in full which essentially means that I overpaid on two loans based on FL's law regarding pdl's by at least 200 percent! Since I only have a single payment left on the two last loans I have with them, I figure we're even-steven! They can take it out of the gargantuan interest rate they charged me before!
Let me know if/when you hear from these clowns again and I'll do same.

It seems like SOO many different 'names' for one Payday loans. Dealing with Payday loans myself, when the 'loan company' was taking money out of my account, it was a different name than when I was 'approved' over the net or the phone. Can anyone give me any advice on what I can do to pay some of these and clear them from my credit? Thanks.

SD please know that ipdls do not (as far as we know) report to the credit reporting agencies...most of them are illegal so can not participate in that aspect of our lives!!None of us have ever had a mark on our reports from them...Now if you would like to start a new post and then list your state, the names of the ipdls, whether they are internet or store fronts (big difference there), how much each loan was for and what you have given them so far, ie: ipdlxxx: 300/200 then we can better give you some advice!! Thanks...

I have a friend that got caught up in the payday loan nightmare. She has a loan with USFastcash and she found out that USFastcash isnt licensed in her state...they took out 75.00 this past week for a rollover fee-which are not allowed as well....I told her to close her account ASAP and open another one.
Has anyone ever filed complaints against them before?

Yes...I filed with the BBB....and they answered because I had a previous loan with them I knew what I was doing, etc. I have filed them with my AG and am waiting for a response now.

Morningstarr430, I DO know that a company, called Cash Call, is on my credit ( deliquent). Do you know a way I can pay them off, with out the high % they ask for? Thanks.

Cash Call is NOT a payday loan! They are backed by a bank.
Federal Law allows them to operate when backed by an FDIC insured bank in any state without a seperate license. Federal law also allows them to import the interest rates from their home state.
Since they aren't a pdl, they don't follow the same laws. Cash Call will sue someone if they don't pay, and they will win because they are 100% legal.
Since they are backed by an FDIC insured bank, usually First Bank of Deleware, they are allowed to import their interest rates from their home state. So the interest rate of 99.24% is totally 100% LEGAL.
This company sucks! They are evil, evil, evil. If you don't pay them, they will sue you. But they won't sue you right away. They will wait a few months so that your balance ballons up, then sue you because they know that once a judgement has been entered against you they will not get their 99.24% interest any longer. |
