I think that once the SOL is out, they cannot sue you for it but they can still collect. You may want to make sure that this account has not been reaged to bring it back within the SOL.

Welcome to the Community Leah is right, legally they cannot come after you, but will still try to collect, as the detb is considered valid until it is paid. If they do bring suit, make sure you answer the summons, and put the SOL part in it. I deleted your duplicate posts, since this is the one people answered to-good Luck..Karen

If NAF (National Arbitration Forum) is involved, they are already taking legal action to collect the debt. I would notify both that you plead statute of limitations as your defense. If you don't plead it, you may lose it. You can also notify them that you are not subject to any arbitration clause and you do not recognize their authority to arbitrate this matter. If they persist, get a lawyer.
FYI: Wolpoff & Abramson is defending a class action law suit in Virgina for ramming MBNA's arbitration clause down everyone's throat.

I have also had a hard inquiry placed on my CR's from Asset Acceptance - I have sent them 1 DV letter that they replied to with a computer generated invoice that clearly was not from the OC and the 2nd DV I sent was to once again ask for validation/verification and inform them I know they have reported erroneous information on my CR's, the reply I received to the 2nd DV was a letter saying "we got your letter - call us".. I have also filed a complaint with the Michigan AG - where should I go from here? Another DV letter? It has been suggested I send a limited Cease & Desist letter but cannot find a good template to use as a guide.
Any suggestions would be appreciated.
