Sub: #1 Tax levy on bank account from collection agency

Help!
I have a tax adviser working with the IDR, Indiana Dept of Revenue, for back taxes.
However, today they levied everything out of my checking account. My tax guy has to get a copy of the levy order but he said if it is from an outside collection agency they won't recognize his intervention. What do I do? My rent will bounce tomorrow and all my bills are due. I have no money and nowhere to get any. How do I deal with tese guys?

The collection agency does NOT place the levy....it has to be done by the originating source. Probably a different department than what you are dealing with.

Thanks, Soap Lady, my tax adviser will call tomorrow. He said Indiana Dept of Revenue rarely levies checking accounts. Third party collectors can do it, though. He has power of attorney to talk with the IDR but not a third party collector because they do not recognize third parties like the state does. My bank statement online says it is a debit memo on an Indiana Dept of Rev. tax levy.
So you think it is not an outside party?

When I was in collections, we submitted the offset lists to our student loan clients based on their criteria. The guarantor submitted the offset...we had no power to do so. Where you working with or paying the CA? Usually when an account is assigned to a CA, you are REQUIRED to work with that agency. Your tax advisor by passing the CA maybe the reason for the the offset. tc

No the tax adviser did not by pass the CA for what the IDR is saying I owe. If there is an amount with a CA I am not aware of it. Can a CA access bank accounts based on a tax levy on behalf of the State?

You knew that a CA was involved?? Then why was your tax guy dealing with IDR?? As a general rule, the OC will not work with an account placed into collections. Have you yourself talked to IDR? Did you get mail from the CA or a notice from IDR that the account had been placed with a CA?

CA's cannot access bank accounts....IDR would have had to signed off on the levy.

Well, this has been one hell of a week.
The IDR gave 2 years of the amount owed on underpaid taxes to a collection bureau(CB). My tax adviser had been working with the IDR, however, they just decided to hand over 2 out of the 4 years I owe. We had discussed a payment plan and were waiting for a response. the CB had the file for a month and they levied my bank account this past tuesday. I now have had hundreds of dollars in fees and a bank account that is frozen. The CB has been ruthless and would not talk about a payment plan. This was based on the fact I did not know they had it and I never received a notice from them. In fact, I received the first letter from the CB 2 days after the levy.
So...I have borrowed the levy amount and I am hoping the bank can unfreeze my account. Maybe I will quit working and just let the state take care of me
