husband credit debt

hubsand chared up many credit cards gambling, cards in his name but used my salary on application. Now we are unable to pay these charges and live. Am I liable? What can we do?

I think you answered your own question. If your husband did not sign your name on the application and the cards are not in your name - then you are not liable. However, if they sue your husband and you own joint real estate - they could possibly put a lien against your home? How much debt are you talking about?

Also depends on what state u live in. Some states are community property states and if ur in one then u are liable for his debt. Unless of course u knew nothing of these and can get a judge to grant u relief since u knew nothing of the debts!

Ty for your reply. The debt we are talking about is $39,000.00. I had no ideas that he was taking out these cards. He has a heart problem and on disability and thought that he could make things better, but only got worse. then he was forced to tell me. I made a good salary but do can not pay his bills and live.

So these cards are actually in "his" name?? Not urs right? He signed for these cards??
Also, what state are u in? Is it a community property state?

the cards are in my husband's name. He got them because he used mt salary on the application. he would have never been approved on just his SS disability. I live in NJ.

Well do u know if NJ is a community property state? I will have to look up that info... but seems to me even if it is and u never knew of these debts then u may be able to get relief from them which you would NOT be liable for them!

P.S. The only thing that concerns me here is, if he used ur salary info then he may have broken laws! I'm not sure of the consequences of this... something u may want to find out before going much further!

Also, u may want to register with the site and have someone call u to discuss ur options!! Or have hubby do it, let him see if he can consolidate these credit cards and have one monthly payment plan!

I didn't mean to panic u Pafal! But before i would go in front of a judge to try and get relief from this debt i'd make sure hubby can't get into any legal trouble for falsifying information on his application!!
I think ur best plan for right now is to talk to someone about consolidating these debts and maybe let hubby know of the consequences for what he's done. (to make sure he doesn't do it agian in the future)
Let's not jump the gun here, i just wanted u to be aware of this and like i said try to register here and speak to someone about ur issues.

Ok Pafal the more i keep thinking of this the more i'm not sure! Maybe it's ok for him to use ur income since u 2 are married!! I've asked someone who knows a lot about the law to come and see if he can help!
And i know this is easier said than done but, what is done is done, u can't change it. U can only work to clear it up. Try not to let this make u sick. Have ur hubby speak to someone about ur situation, (they are very very nice) it can't hurt and u dont' have to do anything if u choose not too!

I agree with Ang. Talk to someone here & they should be able to guide you. Everyone here is really nice. I called the phone line on in a panic one night & the rep was really good at calming me down & explaining things simply to me.
