So, I just got a call from someone from DCS, although she didn't tell me that, she said she said she was calling about a program that I qualified for to start paying back my student loans. She wanted my income information, which I told her I had child support and that I was unemployed but actively looking for a job. All true, but I did leave out that I was married because my husband is not looking to pay my bills.
Now, she talked so fast and said everything would work great and that my loan would be in good standing within 30-90 days. Which I knew about the 9 month rehab, but I can't guarantee when money will be in my account to use my debit card so I couldn't do that. She didn't ask for a bank account or anything. So 5 minutes in I am sold. I gave her 2 references, my mom and dad and then after doing so she said they would be responsible for my $7000.00 debt if I didn't make the payments. Which I was taken aback by, but before I could ask anything she said she had to put me on hold to talk to her manager, Then she said that her manager said I would qualify for $50.00 payment. And they would waive the $115.00 down payment. So still in shock over references being responsible for my debt I take her name and number because I would be stupid for making any type of payment without seeing paper work. And the whole time she "implied" she was with "Direct Loans".
So I get on the computer to see more about who they are and can only find the BOE information, I googled the return number and found this site.
I believe in full disclosure and I have been asking DCS for a $50.00 payment for a year now. I have never denied that I am responsible for this loan.
But, now I am mad because I see no where in all my searches where a loan can be rehabbed in 30-90 days or anything. Is this true?
Is it also true that they can hold the references that I gave her responsible for my debt?
I have always spoken to the people that have called me about my debt and it is the same conversation all the time that I can pay $50.00 and when I get a job they can garnish it or I can increase payments, but I can't do anything over that.
I don't understand why she didn't say she was from DCS? Reason for Editing (Minimum 15 Characters)

Rehab is 9 payments...maybe you have 6 left to go? The only thing that happens after 6 months is Title IV eligibility.
The Department of Ed will not work with you if you are assinged to a collection agency....DCS is under contract and the DOE wont get involved since they are paying someone else to collect.
If you go on unemployment and dont continue making the payments, you will not qualify for rehab.
DCSquick pay? You would have to ask DCS about that.

DCS IS TERRIBLE whatever you do DO NOT DEAL with this collection agency.. there are multiple law suits with them - they will lie to you time and time again.. if they back you into a corner File chapter 13 bankrupcy ...it will protect you from the wage garnishment and student loans are NOT a priority debt in bankrupcy they will have to go to the back of the line - WHATEVER YOU DO DO NOT DEAL WITH THIS COMPANY - I know from experience

I too have dealt with DCS for the past year or so. I got bamboozed and was stuck in a wage garnishment for about a year.Initially they bug you on the phone 5+ times a day, disguise themselves behind your local area code. They are pushy, and say they need to update your information, and get nasty with you if you get evasive. I state that I dont know who they are and need to send me information of who they are and I'm not agreeing to make payments I cant afford over the phone if I dont know who they are collecting for. I was evasive rececently because i know they have my information from my previous garnishments with them. The paywork they send is confusing. On one hand the letter states that your student loan may be subject to IRS offset, wage garnishment etc, please call your representative today. In the next paragraph it states that you may submit a financial statement to show that you are unable to make their requested monthly payments, and that you must submit them within 15 days of the date of the letter. Depending on where you live in the country, it has taken 7 days to reach you. The first time they got me I sent a financial statement, but failed to submit some supporting documents, therefore when I was up for a hearing (that happened w/o me) because I probably ignored some mail I received, therefore some of my expenses were not considered and I WAS GARNISHED 15% OF MY TAKE HOME PAY and not eligible for a reduction for 6 months. DCS did not contact me to say "hey we need supporting documentation?"At 6 months I resubmitted everything, took the "phone call hearing" and it was reduced to 2%. Now they are bugging me again because I changed jobs and they are no longer receiving my payments. They called me constantly disguising behind my local area code. I finally answered and were trying to rid me of this debt by saying I now qualify to have my debt paid and make lower payments. I told them I'm responding to their recent letter, i'm not making any arrangements over the phone and to look for my packet soon. My packet consisting my bills income etc shows I cant afford their payments crossed the mail and they sent me a Direct Loans Consolidation application. It has all these instructions on sign here sign there, and submite w/in 45 days. The paperwork looks so real but I didnt ask them to consolidate. I already have several loans consolidated with Direct Loans which I initiated and are now in forebearance. Now I'm confused because if I'm correct...I'm suppose to initiate a consolidation. If I consolidate this loan that DCS has...it would mess up my prospected payments after forbearance is over. All I can say is dont snooze on DCS, they are grimey, they can find you, your employer and underhandedly garnish you, and its too late to react.

OH!!! I starting venting my experience with DCS and forgot to ask my question (the reason I ended up in the forum) ..lol...Can DCS initiate a loan consolidation? I thought "I the borrower" intiates a consolidation. I think they are trying to get my debt out of their office by sending me consolidation papers that I didnt ask for. Any suggestions or answers?
