In 2003 I got a divorce, in it my ex agreed to pay off a California State Franchise Tax Board lien of $3,000. The lien has since grown to $12,000 and is still on my credit because the debt was in both of our names.

I understand that to California, I am still obligated to pay this debt and they could garnish my wages. I know that I could pay it and then sue him for the money, but I do not have that kind of money.

Is there any way to force him to take care of this obligation?

You say he agreed to pay it. Was this part of the written divorve agreement or just a verbal agreement. In other words do you have it in writing?

Yes, it is written in the paperwork-along with about 20 other bills that he was able to get out of by filing bankruptcy. But the tax lien he couldn't get out of.

If the court gave him that lien in the written decree, you can go back to the court to have it enforced. Check your paperwork, then [probably] consult an attorney.

I don't think it would hurt to send a copy of the court order showing that he is responsible for the tax debt to the FTB. On the document, I would put both your SSN's and the year that it's for.

Good lord....some people are just jerks. They run you into debt then expect you to pay it and have no concern over it and treat you like crap.I hope you can enforce his payment of his half. You shouldn't have to shoulder this alone.
