Anyone know if the TX wage garnishment law changed

in the last two months?

I just got told by ACE cash express pdl that the laws have just changed and they can now do wage garnishment and I said no you can't do that and she said yes we can the law has changed?

I tried a couple of phone numbers, but can't get a clear answer.

So, can someone please tell me who to contact to see if this is the truth or lie?

The only thing I found that has changed is this:

BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 28, Article XVI, Texas Constitution, is
amended to read as follows:
Sec. 28. No current wages for personal service shall ever
be subject to garnishment, except for the enforcement of
court-ordered:
(1) child support payments; [or]
(2) spousal maintenance; or
(3) restitution in a criminal judgment.
SECTION 2. This proposed constitutional amendment shall be
submitted to the voters at an election to be held November 6, 2007.
The ballot shall be printed to permit voting for or against the
proposition: "The constitutional amendment authorizing
garnishment of wages for court-ordered restitution in a criminal
judgment."


But that hasn't even been voted on yet.

And all it changes is that wages can be garnished for criminal judgements.

This information was taken off the Texas Legislator's website. This bill above has not even been voted on yet.

Ok, so we dont have to worry about that just yet. But if we do make a effort to pay off the loan, even if in small payments we shouldnt get affected right?? I hope not.

The people at Ace need to know what they are talking about before they start making threats. I think that a pdl or a high interest rate installment loan company will stop at NOTHING to get money.

From what I've found, the only way you can be garnished is Texas is for child suport or spousal support. If this bill passes, you would could also be garnished for criminal judgements. No loan would be a criminal judgement, it would be civil. So they would not be able to garnish your wages. Now, they would have other means to collect on the judgement, but they would have to sue you and win before they would get a judgement. If you are making payments most places will not sue you.
