I cannot speak for credit cards but i can speak for debit cards.... when calling over the phone my bank would do nothing but when going into the local branch and me signing an affadavit of dispute they 3 times reversed the charges.

I guess what I am trying to ask here, should I just take the dispute forms fill them out for each transaction, and trust that when citibank and wamu send them through to the merchants (again these are all falsely coded there were even a couple of them that came through as a florist) that the merchants can't challenge and the money will be charged back. Or do I need to do something else like get a lawyer and go after my cc companies (I would like to avoid this at all costs). According to some posts on this forum these are illegal transactions that can't be validated, bam no questions asked money returned. When I talked to the fraud department at Wamu the lady was reaming me out for trying to charge back something that I initiated, which believe me has me sick to my stomach as I do accept the responsibility of having an addiction and not being able to stop. I am getting some outside help with my addiction and vow never to do it again. I do however am very aware that not only was I preyed upon by these sites, but these sites were really not fair and ripped me off. I also had not had access to cards for some years now because of a similiar incident of which I payed dearly for and obviously didn't learn my lesson. When I learned that these transactions would not go through anymore I again got some cards for emergencies and peace of mind , Oh boy did that back fire. Thanks for any information regarding this, I am really unable to sleep or relax and am really hoping I can recoup this, never gamble again and get back to a real life!!

Hi there,
This is a shot in the dark, but I figured I'd try. In 2004 my dad died (I was 19). I got about $50,000 and I blew about $20,000 gambling online. All of the charges were directly through PartyP0ker. What are the odds I could sue to recover (or sue and settle)? I begged PartyP0ker to suspend/block me but they wouldn't. Would it be possible to get any of this back? |

I'm really sorry to hear of your loss Brian, I know what it is like to loose a parent at a young age (my mother). As for the 20k you spent. If gambling is illegal in your state you might be able to, but you'd probably have to pay some fines for doing so. I would suggest consulting with a attorney about this before going any further.

hey morozov, my bank just sent me a dispute affidavit to fill out. In the past I just had to type up a letter and send it in. Now that they're using a legal document should I be worried about the bank coming after me for fraud if they found out that I initiated these charges and I'm just trying to get my money back?
Some of the transactions go back to July and I'm sure they'll want to know why I waited so long to dispute the charges. Not sure what my response should be. Thanks for the help |

If you had authorized it and it posted for that amount and there was no fraud on part of the merchant in question filing out the affidavit would not be a good idea. If it goes to court you may be called in to testify to the accuracy of the affidavit.

Well it seems as though wamu(visa) will not chargeback the miscoded transactions, after putting me through an extensive process they determined there wasn't enough evidence so apparently never sent verification to merchants. Citibank (MC) just did the chargebacks right away, no questions asked. I know that the merchants cannot fight back the chargebacks, so what else can I do to get wamu to do a chargeback? I originally disputed that they were not authorized and mentioned that they were miscoded. Any help here would be appreciated. I am no longer gambling, and never will again, getting this money back will really help in my recovery.
