I am at work. My husband calls me and says that UPS tried to deliver a package but I wasn't there to sign for it. I called UPS with the tracking # and they say that it is from Wolpoff & Abramson. I have a credit counseling session scheduled for June 26 that I have to take before I can proceed with filing Bankruptcy. I have looked this company up on the internet, and it doesn't look too good. Any advice from you debt gurus out there?

Do you know the name of the credit company for which Wolpoff & Abramson is making the collection attempt? And are you thinking about discharging this account in bankruptcy?

I think that it is either my MBNA or my Wal-Mart credit account. They are both to be included in my bankruptcy.

Take the credit counseling before you are finally decided with filing bankruptcy? In the meantime, ask this CA or the law office to validate the account in writing. They are required to give you the necessary information about your creditors along with the principal amount and interest charges. Have you checked about their licensing in your state?

Do you mean check out Wolpoff's licensing?

I have the counseling set for June 26. My mind is pretty much made up about the Bankruptcy filing. I can't afford any payments anymore since my husband lost his job.

Yes, I will like to check the licensing info about Wolpoff in your state. You must be sure about this information before talking with them. Besides, they must put the debt in writing first before attempting collections on you. Keep them engaged with this till you complete your counseling session.

Quick question...When UPS tries to deliver this package again today, should I refuse it? I have also been e-mailing this budhibbs.com and he says to refuse it.

I actually work for Wolpoff. We have offices in most of the States. I dont know about any of the other offices but our office is pretty well trained. If they serve you the papers I think you still have the time period to file an answer. But if you are planning on filing bankruptcy I dont think the lawsuit will matter because if the debt is discharged its discharged. Whatever you do dont panic. Im sure everything will work out for you.

monica is correct, don't really worry... I would accept the UPS package and make sure that your attorney gets copies of whatever they give you, so that they can correctly handle it in the bankruptcy filing. Once you file, all collection activity and related suits are stopped by the federal court order (stay). The only way for a suit to continue is for the person suing to petition the court for permission to proceed. Since they are suing on an unsecured debt that is dischargeable, this wont happen.

Thanks JJ. Just got a little nervous. So much going on with waiting on the credit counseling session before I can even file bankruptcy. So much paperwork to fill out and documents to retrieve. I haven't talked to my husband to see if he refused the package yet. I'm wondering what this company can do if the package is refused.

To Monica that works for this firm....get a new job. This organization is the most unprofessional law firm i've ever come in to contact with....besides which, if you do a search on the internet for Wolpoff and Abramson, the first to come up are all the "Rip Off" reports. There's something to that if its there.

I've been working with a debt management company for a couple of years now. MBNA is suing me for $4000. Last year, they went to an arbitration forum and were 'awarded' the four grand, then they tried to file suit based on that. After I responded by disputing the debt, the judge essentially threw it out. They were trying to re-file it a couple of months ago, I was trying to get some direction from my management company, and was not fast enough. They are apparently re-filing the suit for $4000.

I need some direction, I need to know who to write to, how to word it, and I've got TWO WEEKS to do it!

I'm the only wage-earner in the house, we have two kids (one is not even a year old yet) and I'm freaking out.

Help, please!
