Chat InformationYou are now chatting with 'Ada'
Ada: Good evening, thank you for visiting Customer Care. How may I help you?
Molly Sommers: Is this PRLDirect?
Ada: We are a call center, dealing with a number of loaning company.
Ada: In order to assist you better, may I have your first and last name along with your social security number please?
Molly Sommers: Don't you mean payday loan companies?
Ada: That is right, payday loaning companies.
Molly Sommers: Are these companies legal?
Ada: Yes, they are.
Molly Sommers: In both Canada and US?
Ada: We don't have any business with Canada at this time.
Molly Sommers: If I were to get a loan, where would my legal obligations lie? Would they be based on state where I reside or where the loan was taken from, i.e. Malta, Ireland, Canada?
Molly Sommers: Is this call center based out of Surrey, B.C. or Winnipeg, MB?
Ada: In order to assist you better, may I have your first and last name along with your social security number please?
Molly Sommers: Can you not answer my questions?
Ada: Ms. Sommers, for me to be able to give your accurate information, I will need to pull out your file first.
Molly Sommers: You don't need to pull my file to answer these 3 questions.
Ada: I won't be able to disclose any information, not unless I verified that your are one of our customers.
Molly Sommers: Why, I would like to be a customer but first I would like to know what my rights are and the legal rights.
Molly Sommers: Is anyone there?
Ada: I won't be able to disclose any information with out a social security number.
Molly Sommers: Look, if you want my business, I have the legal right to ask these questions. If you don't want to answer them, then that tells me that your operation is a scam outfit and you have something to hide. The questions are general legal questions not specific ones.
Molly Sommers: I do know that in Canada, you have a privacy law, but that refers to a specific individual, not generalities.
Ada: Ms. Sommers, unfortunately since you are not wiling to release your social security number with us, I won't be able to disclose any accurate in formation with you at this time.
Ada: I will have to end this chat, if you are still not willing to disclose your social security number.
Molly Sommers: I don't have to disclose my SSN to have a general question answered.
Ada: Thank you for chatting with us. Have a great night!
Chat InformationChat session has been terminated by the site operator.

Just by this conversation, found out a few things:

1. In Canada, parent company is being investigated that is why they have closed Canadian operations.

2. This company is definitely a scam outfit.

3. They type in their answers that can be found in a book that they are given.

4. Shut this group down, E-Care contact centers.

The address that Dustin gave you is a physical address in Malta that receives mail. It is then forwarded to Surrey, B.C. E-Care Contact Centers own cashtransfercenters and a few other companies.

Actually Mr. Ash is in Winnipeg, MB. He has started another company called Blizzard Interactive.

Miss Texas pulled a Jessi trick and threw a bomb into his seat...lol

When I called Carlos to check my balance with him as I do about every 2-3 days just to irritate him I asked him what he does if he's wearing really heavy boots and his foot gets real sweaty, but you can't take the boot off because your foot might stink. He didn't answer me...lol

I have seven payday loans five of which I have already paid well over the original loan amount. My question is do they have any legal standing if they have collected the original loan amount plus fees to be able to get more money? :(

Jen,
You need to check you state usurious laws as well as licensing for Money transmitters/pdls.
As far as legal battles with them, unless you want to hire an attorney, it may be difficult fighting them yourself.
You can easily just stop paying them, but then your credit could be ruined if they report it, and also the harrassment of the collection companies.
It may be better if you call them and try to work something out with them.
Some will work with you and if you persevere, they may settle for less than you owe.
Whatever you do, don't take any more loans with them!

I am here to make sure loan companies get a fair shake, and to make the people of this forum straighten up and take responsibility for their actions.

I know the people on this forum SAY they are taking responsibility for their actions and you are to a certain extent. I would say the average person on this forum takes about 75% responsibility. And then they try to push the rest off on everybody but themselves.

I will explain so I can make myself perfectly clear. If you took out a loan, you owe the principal and ALL FEES that went along with it. Which means if your loan was for 300 and you didnt pay for 5 months before you closed your account you are responsible for every one of those finance charges and return fees.

If you have a credit card account you are responsible for every penny you spent and every fee the collection company or credit card company should choose to tack on.

You do not have the right to complain about a collection company no matter how "mean" they maybe. The people on this forum are quick to point the finger at others an cry foul, but you tend to forget you STOLE from these companies. The loaned you $300 and you didn't pay it back, you got a credit card and maxed it out buying God knows what and then you didnt pay them back. AND NOW THEY WANT THEIR MONEY BACK, WHAT A SHOCKER.

Who cares if you dont want to deal with the 3rd party collector, you chose not to take care of your responsibilites on time, and not you HAVE to deal with the 3rd party. I wish more companies had the power to garnish wages. I think it would be a slap in the face to society. HEY WAKE UP!!!! For too long Americans have been coddled, and hidden from the harsh reality that life is not fair. Not anymore, WEST TEXAS is here with a wake up call.

Do me favor DO NOT RESPOND TO THIS WITH ANY OF YOUR SAD STORIES OF WOE. You are not the only ones that have suffered. If you had any idea what real pain and anguish is all about you would know that you cant fix those problems in a forum. You have to get up, wipe the blood from your mouth, dust yourself off and scratch and claw yourself back out of the hole...ON YOUR OWN. The true american way. This is called True Grit. Why dont you people try it sometime instead of hiding behind BullS*** laws that screw the people that worked hard to get were they are.

You want to get out of debt. It's real easy, get another job, already have 2 try a 3rd. I did. 4 was my number, but I forgot it's easier to take the lazy way out and complain about harsh practices and "illegal" companies, and BLAH BLAH BLAH the same old things this forum always cries about.

You want out of debt than WORK. Sacrifice Christmas gifts, birthday gifts, duct tape shoes together, sell plasma, live on PB&J's and Beanie Weenies. I did.

BUT FIRST AND FOREMOST QUIT CRYING AND JUST DO IT. Stop making yourselves out to be victims. Your Not. The companies you stole from are.

WEST TEXAS OUT

You are now chatting with 'Arlene'
Arlene: Thank you for visiting Customer Care. How may I help you?
Evelyn Campbell: Hi Arlene
Evelyn Campbell: My name is Evelyn
Evelyn Campbell: Iwas considering applying for a loan with your company
Arlene: May I have your first and last name along with your social security number please?
Evelyn Campbell: I was hoping you could answer a few questions for me
Evelyn Campbell: My name is Evelyn Campbell
Arlene: May I have your social security number please?
Evelyn Campbell: I do not feel comfortable giving you my soical security number as I have not applied for the loan yet, and according to the law I am not obligated to until I do so, but what I was wondering is where are you located?
Evelyn Campbell: I clicked on the contact us link
Evelyn Campbell: but there isn't an address, and I wanted to check the better business bureau
Arlene: The head office is located in Level 8 Suite 3, Plaza Commercial Centre, Bisazza Street, Sliema, SLM15, Malta.
Arlene: Would you like to complete an online application now?
Evelyn Campbell: Where is that?
Arlene: We can complete an online application here on chat.
Evelyn Campbell: I have a few more questions first, if you don't mind
Evelyn Campbell: where is malta?
Arlene: It's in Europe.
Evelyn Campbell: really, how cool, i have never heard of it
Evelyn Campbell: where in europe?
Evelyn Campbell: are you a member of the better business bureau?
Arlene: Yes we are.
Evelyn Campbell: cool, but i am not sure where on the bbb website to look at european companies
Evelyn Campbell: could you direct me to the link?
Arlene: Unfortunately, I do not have a link for that.
Evelyn Campbell: ok well i will look for it later, but my next question is what is the apr?
Arlene: I don't have any idea about apr.
Arlene: What do you mean by apr?
Evelyn Campbell: APR = annual percentage rate
Evelyn Campbell: the rate of interest on the loan
Arlene: Cashtransfercenters.com charges $27 per $100 borrowed for a maximum loaning period of 14 days.
Evelyn Campbell: are you sure?
Arlene: Yes.
Evelyn Campbell: i think that sort of interest rate isn't legal here
Evelyn Campbell: i'd have to check to be sure, but i don't think you can go over 25%
Arlene: That's our fee for every $100 borrowed Ms. Campbell.
Evelyn Campbell: you never did say where in europe malta is
Evelyn Campbell: do you have any locations here in the united states?
Arlene: No, we don't have an office in the United States. Malta is in southern Italy.
Evelyn Campbell: wow i have always wanted to visit italy,
Evelyn Campbell: so you aren't incorporated anywhere in the us
Arlene: No, we're not.
Evelyn Campbell: where else are you besides italy?
Evelyn Campbell: does italy have a better business bureau of their own?
Arlene: That's our only location.
Evelyn Campbell: i always thought foreign companies had to be incorporated in the united states in order to do business here? Is your company required to have any sort of special license or permits?
Arlene: Yes. We are a member of the better business bureau, the reason why we can do business outside Malta.
Arlene: Is there anything else I can help you with today?
Evelyn Campbell: and you know i just looked up that interest rate, and the most I can be charged is 25%. anymore than that is a felony and your company could be fined 10k, so are you sure about that interest rate?
Arlene: I am sure about that. There is $27 per $100 borrowed.
Evelyn Campbell: the better business bureau is the reason you can loan in the united states? that is just an organization for consumer's to report to if they have problems, and the bbb investigates the problems to resolve them.
Evelyn Campbell: i have it right here...25% is the max...don't you accommodate your fees for every customer's residential laws?
Evelyn Campbell: i can give you the link if you would like
Arlene: Unfortunately, without a social security number I cannot answer your question any further.
Arlene: May I have your social security number please?
Evelyn Campbell: no, by law i do not have to give it to you. Jennifer Granholm passed that law a couple of years ago, and by law you cannot deny me service either.
Arlene: Unfortunately, since you do not want to provide us with your social security number, I will have to terminate this chat.
Arlene: Thank you for chatting with us. We look forward to assisting you in the near future.

Arlene must be the only one that does chat. She is the one that I did a chat session with a while back. Okay she claimed they were a member, right? Well according to the BBB they are not a member. And they don't have businesses in the US, so why do they use the addresses in Oaks, PA and Delaware? Good going polly.
