is this account current other than the july payment?if so i would just contact the attorney and say you plan to make good.an attorney collecting has to obey the fdcpa just as a CA

Yes, I have only missed this months payment....I can mail it out today but they wont get it until probably Monday? I just dont want to get a suprise in the mail....I always try to make sure I pay them monthly but I forgot until now.....

i would let the attorney know that you plan to make good,i speak from experience.the time it takes to put in a garnishment

Tweety if you have always paid on time and just happened to forget this payment, call the company and explain what happened. I was in a situation such as this at one time, called customer service, explained what happened so they removed the late charge and also removed any record of me being late. They will only do this one time as a courtesy though, at least the clothing company I had a credit card with. It might be worth a try. :)

When they contacted you a couple of months ago, was it for the same card? I haven't had attorneys' contact me, except when it was turned over to the collections, or I was really late, like 3 months. I think I would check into that one with the store, just keep calling someone until you get a nice one!..karen

I would just send in the payment like you normally do and then if you see a fee hit call them up and dispute it. You may or may not have luck getting them to remove the fee.

D & S - this account is not with the OC, it is with a JDB attorney. She had an agreement to make payments and will be a couple of days late. She just wants to make sure that they won't start a law suit.

Even if its a JDB I would still make the payment via mail per your agreement even if it is a couple days late and then wait for their reaction. It is obvious that they are worthless on the phone so that seems to be the only option here. I suspect it will just go through like normal but you never know with those bozos.
