National Action Financial Services – has anyone dealt with them?

I am helping my neighbor out with National Action Financial Services. Before he had a different company, N/R/A trying to collect on an old debt from him. The debt is at least 10 years old since hr made a payment and the SOL in our state is 6 years. N/R/A had it on his credit report and Trans-Union deleted it but Experian verified it and Equifax we are waiting for an answer. I called N/R/A and they had no information so I bitched them out for verifying an account with the credit reports when they have nothing in the office. I told them if they verify the debt again, they will b liable for FDCPA and FCRA violations.

Now he gets the letter from National Action Financial Services Inc.. It says who the original creditor is, Mobil and is for $75. They have the 30 day dispute on the letter but says and I quote:

"Your account is seriously past due and must be paid in full or we will proceed with appropriate collection activity."

I plan on calling them and see what that means, play a scared person role,lol. They have not been on his credit report yet and by law, they can't the debt is older than 7.6 years and is beyond the credit reporting period. I also see that this company has many lawsuits against them and I would like to help my neighbor add to that.

What is the best possible thing to do at this point? Should I send a debt validation letter OR would you just send a Cease and Desist letter stating the SOL has expired and that the credit reporting period has expired? What would you do?


See if you can find out the owner of the debt. Have you seen the name Pinnacle on any of the paperwork, by any chance?

National Action was sicked onto me me by Pinnacle. I DV'd NAFS and they sent this lame attempt at validation, which was basically the name of the account and the amount typed on Pinnacle's letterhead. I sent them a letter back telling them this wasn't good enough and to try again.

I didn't hear anything more from them.

Skip ahead a couple of months and Pinnacle has now put the Law Offices of Thomas Landis on me for the same account. They just pulled the account from National Action Financial Services and sent it to another CA for collection, when they knew I had disputed it with NAFS and they couldn't properly validate it.

Add to that, the fact Pinnacle is reporting it on my credit report and they aren't reporting it as disputed.

My attorney is sending a demand letter to Pinnacle advising them they need to respond or we will sue. Pinnacle is just one of two CA's I am currently in the process of suing.

Well I don't have a website, I pay my bills, I have excellent credit, a great job and no judgements, eat out a couple times a week and my wife is a piece of a$$...how about you loser? Have to surf under the radar anonymously...have to hide behind a guest identity? There's a word for what you are...several actually...but I would say you are a COMPLETE AND UTTER WASTE OF HUMAN SKIN. What a bunch of crapola on this channel. If it's under $100.00, then pay it. If it's over argue and sue everybody. There are disputes on both sides of the fence. These morons- National Action Services tried to disguise themselves to me as Verizon. And that I owe them $400.00 on a bill back in 1983. Funny thing is, I've never had Verizon except when it was AT&T. Found out that my crack head little brother gave Verizon my SS# and ran up a bunch of porn on the DirecTV. He's locked up but, I've talked to Verizon. They don't know squat. So I get harassed everyday on the phone by these a$$holes for nothing.

Why would anyone pay an unvalidated debt even if it is only $1??? The fact that it is unvalidated or not even your own account...I sure as heck would not want to pay someone else's debt.

You should report this debt for identity theft since that is what your brother did-stole your identity. Then you take a copy of that report and send it to both Verizon and to the collection agency.

These National Action people are calling our cell phone number and leaving voice mail messages. When we call them, they are looking for some person unknown to us. We ask them to stop calling our number and they say that our number is removed from their system, BUT a week later we get another call from them. Been going on for almost a year. Spoke with a woman there today and she was not very nice and very unprofessional. The next call from them and we plan to start filing complains with Indiana AG and the FTC.
