I received a letter from this Rannefeld & Associates stating that I owed $952.78 for a credit one credit card. I sent them a fax yesterday stating that I wanted validation of this debt. I received a phone call from this Ken Chandler, he said that since I acknowledged having the credit card that they were not required to send me validation but that he would fax it to me at my home number. He stated that they are not a collection agency that they are a lawfirm out of Addison Texas and are collecting for CACH LLC, for a credit one credit card that I had. I never received anything from this CACH LLc place and wanted verification of this debt. He said they are lawfirm and therefore do not have to abide by the rules of a cease and desist order. He told me I needed to borrow the money from friends/family to pay this debt. I faxed them a debt verification letter and he stated since I had admitted that I owed this debt they did not have to provide it but was going to fax it to me later today. I have received nothing. He told me to contact a lawyer and since I had declared bankruptcy 3 years ago that I couldn't do it again. I asked him if he was looking at my credit report and he basically said yes. He said that by looking at my credit they wouldn't give me a loan. Well that's good since I wasn't asking to borrow money from them. All I wanted was verification of this debt. He stated that this was just a stall tactic. He also tated that I was paying on another loan and that I needed to pay this account. I stated that I was going to be working with a debt management company and he said they don't work with them. He told me that if I could get him the money this month that perhaps his client would settle for 80% of the debt. Right I now that they are bad debt buyers. He kept telling me I needed to contact an attorney and that they were going to sue me. I told him I am on disability and my benefits are exempt from attachment. He stated that I was wrong. I told him maybe he should study the law a little better if he works for a law firm and learn what they can and can't do. I know they can't attach anything to my social security disability payments. What should I do?

45% of your wages? I kinda doubt that. I seem to recall that Federal law sets a limit of 25% of disposable income.

Looks like Garnished is full of crap.

Your right Unclewulf, federal maximum for percentage allowable for wage garnishment is 25%, that is total.

So if one creditor is garnishing your wages for 12.5%, another can garnish your wages for up to another 12.5% up to a total of 25%, once this capacity has been reached any further judgments would have to be place on hold until an existing judgment is satisfied.

State statutes are passed to supplement or to add to existing federal statutes and a state cannot pass any laws whose purpose would supersede federal statutes unless the existing federal statute was amended or abolished to allow this.

sounds like you have a pickel on your hand I had a run in with the firm also. My experience was horrible I did have to go to court they actually served me court papers at my job. I disputed the debt at first because of the fees they tried to hit me with which didn't work my lawyer told me it was best to settle out of court only problem was about time we settled I ended up paying 6k more then I originally owed due to the lame attorney fees and court cost I could have avoided the problem by taking care of the debt sooner vod did bur me about a week or so they where fast with the requested documents. So be careful when requesting documents rannefeld is quick to threaten action because they will. They want to get you to court so they can get more money from you Ken Chandler kept saying that it was nothing personal but business. He stated they make more money getting the files to court then they do at first due to the additional fees that are added. My attorney it seems gave me the wrong advised not only did I have to pay him 1200 but had to pay CACH attorney fees also all because we kept holding out and stalling hoping they would settle for less which didn't have my advised would be to try and pay early because waiting out doesnt always save you in the end.

I probably was an idiot for listening to you guys. Always telling people to file suit that doesn't always work. I tried that and it failed only pissed off them more. It would have been nice to know that me verbally telling them not to call doesn't work

saxwoman sounds like your trying to beat the debt you havent stated anything else about vod sounds like you know owe the debt and your trying to beat it by skipping out on your obligation what goes around comes around. If you actually wanted to pay you would rqst vod and wrk out a solution.
