Hilco Receivables LLC - are they a collection agency?

Okay, I have a question. I have a loan with MBNA that went into charge off, that I am paying to a collection agency by the name of "Phillips & Cohen". They send me a statement every month, which I really like because its documentation that they have received my payment and have applied it the balance. I like being able to see the balance go down.

My question, they show 'their' client as being 'Hilco Receivables LLC' not MBNA. Are they a collection agency? [Hilco] or are they MBNAs 'in house' collections? If so, then that goes back to my question about a collection agency collecting for a collection agency. Only MBNA is on my credit report as a charge off, no other CA is listed. just curious who Hilco is.

I have another account that is also this way, they have their client listed as Midland but they're not the OC.

just curious, thanks, shirley

thanks twokid....so if what you say is true, then I do have a collection agency collecting for a collection agency. I can't do anything about it, or rather, what can I do, [nothing] since only the original creditor is on report. none of these other guys are. I was just curious who midland was. thanks for responding!!

So far, it's still better because your CR is not reporting any collections. If the CAs enter any remarks for which they have the rights (if the OC has authorized them), this negative info will stay in your file for a period of seven years. It's still better to see the collection agency away from your CR. But they can hit your file in case of delinquency. Make sure that you don't let this happen.

I'm not John. And you're totally right, I'm pretty lucky that CAs aren't on report making my situation even worse. I have NO collection agencies on report just original creditors and even though Dell and wells fargo aren't talking to me nor the collectors that are holding these accounts, theres still no CAS on report. I have one account that was sold, so its showing as PAID in full on report, and I'm paying to collection agency on it and they're not on report either, so thats a plus for me.

Yes, I will write and ask them what the deal on it is. I know it is MBNA because I matched up the account numbers and they are the same. Just wasnt sure where Hilco came in. Maybe they bought it from MBNA and then turned around and hired someone else to collect. I don't know, but I will ask them. thanks John

FYI guys. Hilco buy debt but they're not license to "collect debt" so what they have to do is buy debt then outsource a collection agency to do the actual collection.

Also - Once you settle with their collection agency they take 30 days to close the account. and then another 30-45 days for them put "settle or charge-off" on your credit report.

I'm still waiting for my 30 days to arrive.

I have been contacted be a collection company that is working for Hilco...I asked them if they could make a settlement on the account...they told me the lowest that they could go was taking 20% off the balance and i would need to send payment in full. I told them that i have $750 and asked if they would take that as payment in full...they guy told me that he couldn't even submit that offer...i don't understand why he can't submit the offer. he told me that Hilco was the company he has to submit to and that if i wanted to submit that request i would need to do that myself...(not very nciely did he say that) the man that i spoke with was abrasive and so i ended up hanging up and when i called back 2 days later i was reprimanded by one of the representatives and told to not let that happen again (as far as hanging up the phone)...anyway I don't understand why they can't at least submit the offer....

HILCO uses a legal firm that claims they are the debbt collector for Hilco. They will ONLY take 80% as a settlement and even then, will freeze your assets in the bank. They served someone - not me - and went to court without my knowledge to do that. Once my bank account was frozen was the only time I found out. I called them and they LIE about all aspects even up the line and from state to state offices. They made arrangements and then used that info to further freeze other assets. Welt Weinburg. BEWARE!

If you are receiving statements and it has the HILCO name under the original creditor this could mean that MBNA has sold off the account for pennies on the dollar to HILCO LLC, Which mean they only purchased your debt at a small fraction of the price and now will try to collect over 180% more than they should. Phillips and Cohen are very likely to work you out a settlement so that you do not have to pay the full balance and also it will stop all the collection attempts on your account. Talk with them see what they will work out and get it done. My only advise to you that settle out debts with creditors is to make sure that you get the "settlement agreement" in writing first before putting down any funds.

Please go the the web site for what lies in your debt. What they did is against the law. You need to sue them and get thousands for what they did. I just started with suing collection compaines and have made monies. Look up Fair Credit Collections Practices Act.(FDCPA) it will show you all the rules they have broken. Hope this helps.
