Collection agency is harassing me. I need help

Yesterday I received a bill from midland credit management saying they recently started handling the account that I had with FCNB....I don"t know anything about account with FCNB nor ever heard of Midland Credit Management. They say I owe $948.63 or $474.32 if paid before 2/4/06. What should I do, I'm in Ohio this took place in San Diego, CA.???? I have also heard that Debt consolidation can help me outta this situation.

You need to request for an itemized statement about this account from the collection agency. The federal laws give you the power to ask the detail of the debt from the CA through debt validation. More details about this process are written in this link:

The FRCP laws state that the collection agency has to serve the details of the debt within 15 days from the date you placed the request or else there is NO DEBT.

Sometimes, the collection agents are very intimidating and will often attempt collections on a debt about which the person is not aware of. In order to know whether the debt is legitimate or not, ask the CA to give you the details as mentioned in the link above.

Once you have the accurate picture, make further arrangements with the company and pay it off. If you find that the details given by the CA are not correct, place the item on dispute with the company. They will have to verify it with your lenders before making any further collection efforts.

I live in ga and received a similar notice also mentioning first national bank. I think they bought some bak paper and are trying to stick us with it. One of my friend has advised me for debt consolidation. It can help me to stop CA harassment calls.

If MCM decides to try to validate the debt, make sure you scrutinize everything. I am filing suit against them for providing false documents to try to validate a debt that is in fact false. Specifically, they like to provide copies of past statements. Those statements will have an address and date on them. MCM may falsify the statement to show your current address on some past date, even if you did not live at your current address on that date.

I have already gone through this page. But it didn't deal with the debts that are really owed. I really owe some debt to Verizone. MCM is harassing me for that debt. What can I do now? I live in San Diego.

Hi All,

Over six months ago I got a new phone number for my office. The first month or so there were the usual calls for the last holder of my new phone number, collections, but reasonable enough people. Except for MCM. Today was the first day I got the caller to give me the company name!!!!

The phone company had to put a trace on my line because of the calls from these people! An average of three times a day calling and even using outrageous approaches, and one even called me a "lying F***ing C***" when I said there has never been anyone here by the name they were asking for.

I understand that people lie to them all the time. But to race headlong into what's now at over fifty separate grounds for harassing phone calls? That just screams "shady" to me.

The lady that called today was reasonable, but not enough to prevent my swearing warrants out against them.

Not Me...did you ever send them a C & D? If not, do that ASAP...start the process of collecting evidence so that you can sue them if they continue to call you. BTW...Log those dates and if possible record them (find out if your state is a 1 party state or 2 party)...altho, if I believe MCM "says" they record, so you may already have their permission. If you log the dates and times they call, and they do record, then you have their own evidence to use against them. The cursing at you will definitely get your AG's attention!!

The State I live in it's very easy to swear an arrest warrant out for a harassing phone call. This has been going on for months and today was the first time I didn't get hung up on or cussed when I asked "what company are you calling from?"

Recording : I am in a one party State.

I started collecting evidence a few weeks into it when an insurance rep for the former number owner called. I started my spiel about the number being new and she told me to please refer all calls to her direct line. So every date and time, even late into the night and obscene wee hours of the morning are very well documented. Every other collection company was quite agreeable, but these guys are doozies.

The "quality" of the people working for this company makes me feel sorry for anyone whose personal information in in their hands.

I have been getting calls from MCM, six just today. I am ready to notify someone about the calls, calls for someone else who lives at this address... Today, I spoke some with a manager in India. Then, I asked him if he understood what I had said (the English). He responded by insulting me... MCM is trying to contact someone who works two shifts. I told the manager this; I said that phone contact is difficult. I asked that a letter be sent. I noted that the phone calls were bothering other members of the household; I threatened to call the police... Why would India allow U.S. debt collections to be happening? People in India likely do not understand how Godless U.S. conservative business people can be. Innocent Indians, but very willing to drop their humanity for a paycheck.

I received a call 07/23/2012 regarding an old debt from 2006. First off I had send them a letter to Cease and Desist contact due to the SOL has expired. I in turn called Midland Collection Agency @ 888-403-6206, I spoke with a male by the name of Tyrone Segal with an accent. I instructed this male that I have sent a certified letter back in May to Cease and Desist contact if they must contact me only due so by letter. I also instructed him of the laws they have violated and that I was going to send out another letter and Cc: The Texas Attornery General, All 3 Credit Bureau and include a copy to them (again) since they fall to adhere and abide by the first letter.
Tyrone Segal informed me at that point that he was removing my name from their files and would no longer be contacting me.
Know your rights. Midland will milk you if you allow them to do so.
They cannot file a suit against you because they are not the person you owe the money. They both this debt. They took it upon themselves to buy this debt. (How you going to make money off something you did not own in the first place.)
Secondly, most of the time the Status of Limitation has expired.
They cannot garnish your wages.
