Hi aem, I answered you on the other thread that you started about this. You should go check it out if you haven't read it already. I know you said you already wrote and told them that this debt was discharged in your bankruptcy but I feel that you should write them again and include a copy of any paperwork that you have to prove this to them--again--with a cease and desist included telling them NOT to call you or contact you about this again. Send it certified return receipt. As I said, if you have your proof that this debt was in fact included in your bankruptcy and was discharged, you have nothing to worry about, whatsoever. stay strong. Shirley

I would just send them a cease and desist letter with a copy of the banruptcy papers where they are listed as a creditor and it was discharged. You should have nothing to worry about. I had a discharged bankruptcy a few years ago and this is what I have done in the past. They can't sell it to a third party collection agency either. You may also want to check your credit reports to see how the discharged debt is listed on there. I had some say it was a write off and not discharged in a banruptcy. It has to be listed as part of the bankruptcy so it is something that you may need to dispute with the credit bureaus.

I did send them the proper paperwork showing bankruptcy was discharged, not just written off. They continue to call, so another letter sent certified is in order. My bankruptcy was discharged in 2000. This is the first I heard from mcm/aka fingerhut. I have worked hard these past few years rebuilding my credit. I am doing good, too. Thanks all for your input.

No one can start collection activities on a debt that is discharged in bankruptcy. It is considered as a punishable offense. Consult an attorney too and file lawsuit to reopen the case.

OK...I sent them the paperwork, certified. They claim they never got it. I filed a complaint with the FTC; they said they were going to look into it. They are still calling. What's the next step? My bankruptcy was discharged in 2000. I don't have an attorney.

Since you have sent all the paperwork through CMRRR once they receive the letter, the receipt will be returned to you. However, if they never pick up the letter, you have the certified mail number with you and it can be served as evidence that you tried to contact them.
I would also suggest consulting an attorney to give the matter a legal shape. By doing so, you can tell them to contact your attorney when they call you next. Keep us updated on this topic.
