Tribal Loans - NE

Hello-

I live in Nebraska and have had a couple payday loans that I'm trying to end the cycle on. They are with the following:

Mobiloans
Plain Green Loans
Big Picture Loans

Ive paid more than the principal on all of these and I did file complaints with my state attorney who did say Nebraska State Usury rate is 16% and doing further research looks like I'm only responsible for the balance.

Mobiloans has refused to work with me or answer any complaints at all and say my account will be charged off after 60 days which is in a couple days.

Are any of these lenders actually able to sue me or send me to collections?

After I have these loans done I'll be out of this horrible cycle!!!

Not surprised at all because they did the same thing with me. They gave me the same threat. But don't worry about lawsuits because they can't sue you. They are illegal. Remember? Let them charge off your account. They can't report to the credit bureaus. So you'll be fine.

Thanks guys! I just received an email from them this morning saying they will no longer respond to me because I've told them the same thing over and over again. They reported me late to TransUnion but I'm disputing it so hopefully it will get off my credit report!

Hi Sarah,
You don't need to worry, just pay attention to pay off the principal amount you owe to them. Illegal lenders can't sue you for being default. Just wait for their next move and stay away from the payday loan trap.

These are the tricks they use to frighten the consumer. If you have [aid the principal amount, then don't worry. They can't sue you. But you can do a lot against them. If they ask you for money and disturb you after repaying the principal amount, then make a complaint against them to the State's General Attorney.

I have received the same reply from them. Still fighting for getting a refund from them. Don't know if I will succeed. It's a long battle. Let's have patience dude. They are tribal and hence illegal. They are a hard nut to crack.

I'm not trying to get a refund, I've already paid the principal. I just don't want to be taken to court......can they make you go to tribal court?

Hey Sarah,
You don't need to worry at all. Tribal lenders are illegal as per the federal law, so how could an illegal entity can sue you or take legal actions against you :)
Just chill, no one's gonna take you anywhere.

Tribal court??? Just forget it. They can't do anything. All they can do is send letters after letters stating various reasons why you should pay your payday loans. I regret the day when I borrowed money from a payday loan lender.

Has anyone actually had experience with these companies after they sell your debt off? Are the debt collectors able to sue you? Are they legit companies or scumbags?

Which companies? Mobiloans, Plain Green and Big Picture? They are not legit companies. They are scumbags. Okay. Debt collectors can't sue you for these debts. These are illegal loans. Debt collectors know this fact very well. They won't waste money on legal fees.

Debt collectors can't sue anyone legally to collect illegal loans. AS a matter of fact, illegal payday loan lenders or tribal lenders can't take help of a collection agency to recover the debt amount. That's the reason they used to charge 300%-500% interest on these loans.

I also have the same three payday loans and live in FL but I’m in the midst of improving credit for home purchase and wanted to know if the timing of following the steps that you outlined would actually be a bad idea and have a negative affect on my progress/credit score and perhaps I should wait? I have paid almost twice my principal thus far. They are all tribal loans-Mobiloans, Arrowhead, Plaingreen and Bug Picture.

It won't have a negative effect on your credit score. Trust me. They are tribal payday loans. So they can't report to credit bureaus or your credit report. Consequently, your credit score won't drop.

Illegal lenders can't report any unpaid loans to credit bureaus. If the principal amounts are paid, they can't do any harm to you legally. So, check out your credit report once, you might have few errors on it.

I was sent a certified letter today from Jacobson Law Firm (I wasn't home when it came and I wasn't able to pick up from post office yet)- I'm freaking out. Thinking it's coming from Mobiloans as my account was just charged off. Do you think I'm actually getting sued on this loan?
