Plain Green Loans help in CA

Hello, I have an installment loan with PGL which I just found out is not legal in CA and I sent them an ACH Revocation letter that I found on this site on 1/17, didn't hear back, so I resent it on 1/20. They did not attempt to debit my account that I know of on 1/22 (I asked my bank to put a block on them) and just now have been getting random phone calls but no messages but I know its them as I've looked up the phone numbers online. I originally borrowed $800 and paid $1400+ so i requested a PIF letter based on this as well as a refund. Any advice on what to do next? They aren't my only installment loan but I'm trying to tackle them all one at a time. Thanks for any help/advice!


right on helpinaz.you would think they might try different tactics when someone gets wise,but as magneeto says in x-men the last stand.these people never learn.pathetic in the extreme.

Yes, you need to stick to your guns on this one.. I would resend the original letter again and remind them that you are a resident of a state that requires all lenders including online lenders to be licensed in their state to lend to their residents.. And since they are not while you are not obligated in any way other than morally to even repay back principal you are willing to do so - and they need to take in to account the total amount loaned - minus any and all payments made to date on both and that is the only amount you are willing to discuss. While they are getting this into understanding you are free from them taking money from your account and you do not send them any thing or as far as I am concerned even worry about them until they agree.

Simply reply to them reminding them that you will only be paying back principal balance and how you propose to do it .. you don't send them anything until the agree.. if they hold out for a while use the money for something else and you will pay them when you are ready.. they are not in control here you are..

Spotloan sent me this just now:

There is no acknowledgement of my offer to split my balance due of $285.19 (from the 2 spotloans I borrowed less all the payments I made). Should I reply back or just pay according to what I proposed?

If you are okay with what Mobiloans is offering go for it - Money order only - and mail certified receipt required US mail - proof of receiving.. Spot Loans may take awhile and you are not paying them anything until they do agree so oh well.. Keep us posted on progress and if you have questions holler.

Great news Mobiloans sent me the following this morning, accepting my payment offer:

Your correspondence has been directed to me for review and I thank you for the opportunity to assist you at this time in connection with your MobiLoans Line of Credit Account (“Account”).

We understand that all situations are different and would like to offer you the opportunity to pay the remaining principal due on your Account in the amount of $100.87. We are willing to accept your proposed repayment schedule. For confirmation I have listed the repayment schedule below:

o February 16, 2015 - $50.00

o March 16, 2015 - $50.87

To answer your questions regarding the legality of this loan, your Account Agreement indicates that your Account is governed by the laws of the Tunica-Biloxi Tribe of Louisiana, (the “Tribe”) a sovereign nation recognized by the United States of America. As such, the laws of the Tribe permit MobiLoans to offer the Account in accordance with Tribal law.

In addition, MobiLoans, LLC is organized under the laws of the Tribe, is owned and operated by the Tribe, and operates exclusively on land owned by the Tribe. As such, MobiLoans is an “arm of the Tribe,” and entitled to sovereign immunity and therefore not subject to any state laws.

In any event, pursuant to your request, we have removed your contact numbers from our system and we will make no further ACH debits from your account.

I haven't heard back from Spotloan yet, I offered to pay my principal leftover balance in 3 payments. Hoping that they get back to me soon. Really glad I am getting these PIFs as the money I would have paid toward these fees each week is now going to be saved to pay more off on the legal loans that have a longterm due date - for example, Cash Call is due in like 2018 :( Rise is due next September and is $240 every 2 weeks so if I pay that one down, that is about $500 a month once I'm finished that I can shift over to Cash Call as I think I can pay that one off faster than Brookwood Loans.

They are a debt collector - I am sure that Mobiloans sold the balance was to them... I would wait to see if they contact you - and when they do tell them they have purchased illegal debt..and send them a cease & desist letter..
Keep proof of what you borrowed and what you paid..

I would combine the two together and demand PIF letter and refund.. Total of $1500 borrowed - total of $1214.81 paid on both - so leaves $285.19 is correct.. that is what I would be offering and not one dime more - and remember until they agree they get nothing..

I actually had 2 Spotloans - the first one I borrowed $700 and paid $472.04 before paying off the remaining balance of $629.88 so on that one I overpaid $401.92, this was over the period of October-December. In my letter to Spotloan should I reference both loans and offer to pay the remaining principle balance on the current one subtracting the overpaid fees (so basically, $285.19)?

This is the subject line I used before with GP & PG - "Customer Issue: Cancel my payment or loan"

As for Spot Loans - you tell them what you are willing to pay when, and you tell them it will be via US Mail via money order only... and when and if they agree they get the rest of their principal.. you are only doing this because it is the right thing not because you have to .. and if they refuse to your terms then they get nothing..

Some are willing to work with you - you will more than likely have to default to do so - Cash Call will more than likely be the toughest and the one that will report to credit - I am sure that your credit can take the hit for now and then work on disputing repairing later. If your credit was great more than likely would not be in this forum asking these questions like the rest of us...

Thank you sooo much! Lendup is working with me so I am going to split up the payment over the next 30 days.

I have a question on the subject line ppl use for the ach revocation emails to the tribal lenders, what are you putting in there? Anyone have experience with Spotloan in terms of a successful payment arrangement?

For the legal lenders, is it your experience they will work with folks in good standing or do I need to default in order to get them to work out payments with me?

I hadn''t replied back to them and received this email this morning:

My name is Michael H and I am a Credit Service Manager here at Spotloan. Thank you for your recent email regarding your loan terms.

BlueChip Financial, which owns the Spotloan brand, is a legal tribal lender and has a valid lending license issued by the Turtle Mountain Band of Chippewa Indians (Tribe). Your loan was legally issued under the laws of the Tribe. Spotloan makes all loans from our Reservation. When you took out your Spotloan, you promised to repay the loan amount with interest. But it’s more than a promise – legally, you entered into a binding contract when you electronically signed your loan agreement. This means that you need to pay back both principal and interest.

Your Spotloan account history shows that you received and agreed to the complete terms and conditions of this loan. Based on your promise to repay the loan amount plus interest, Spotloan deposited $800 in your account on January 5, 2015. At that time, you authorized us to automatically debit your account for your scheduled payments. You have missed your prior payment scheduled for 1/29/15. Your outstanding balance, assuming you paid off all principal and interest today, is $903.63. Your next payment of $112.89 is due on Thursday, February 12, 2015.

When you took out your Spotloan, you agreed that any disputes would be decided by arbitration and that tribal law would govern enforcement of that decision. You remain obligated to repay your loan as you agreed.

We understand that you have revoked your consent to ACH withdrawals. You are absolutely permitted to do this. We have noted your revocation of consent in your file and we will not attempt to automatically debit your account again.

However, you are still obligated to repay your loan according to the loan terms. This means you are legally required to repay both principal and interest. Since you have opted to no longer permit ACH withdrawals, you can make a credit, debit or prepaid card payment by calling 888-681-6811. You may also mail a check or money order to our mail processor at:

They do not appear to be acknowledging the previous loan where I overpaid. Do I hit them back with your suggestion of only paying the principal balance after factoring in the previous loan?

When were you due? How did you send ACH revocation letter, if you sent from their own website you should have received at least a general email response.. Did you tell them that communication needed to be made by US mail or email only - if not you should.. You will hear from them - some times they take a while.. Did you follow all the steps on how to deal with in the link below in my signature line... if so you should have nothing to worry about..

Who else do you have loans with? if they are all illegal - better to deal with all at once and keep them from taking any more money from you!!

It was due yesterday, 1/22. Funny enough almost right after I made this post I got this email from them:

We are sorry you are not satisfied with your Plain Green loan. After a detailed review of your account history we have reduced your balance to zero, and closed your account from further activity. Meaning, you will no longer be able to borrow from us in the future.

To further clarify your questions regarding the legality of this loan, Plain Green is organized under the laws of the Chippewa Cree Tribe of the Rocky Boy’s Indian Reservation of Montana (“Chippewa Cree”). Plain Green is owned by the Chippewa Cree, and operates exclusively on land owned by the Chippewa Cree. As such, Plain Green stands as an “arm of the Tribe,” in the view of the United States state and federal courts. Therefore, loans made by an arm of a sovereign Indian nation are not subject to state law. This is NOT a payday loan.

This letter is written to help you understand that Plain Green and its loan contracts are governed exclusively by the laws of the Chippewa Cree.

Nevertheless, pursuant to your request, we have removed your contact numbers from our system and we will make no further ACH debits from your account.

Here are my other ones, its so much i feel so embarrassed. I want to figure out who is illegal so I can stop this downhill spiral and for the ones who are legal if there is advice on how to work with them.

Mobiloans - Original loan $1000, borrowed additional $647.62 since then, using their line of credit option. Total paid in fees to date is $1,546.75

Rise Credit - Original loan $7000, paid $4,142.80 to date, their system says I have a balance of $6,180.59

LendUp - $308 due on 1/27 (borrowed $250 for 30 days). Sent them an email asking if they offer an EPP to pay this back.

CashCall - $2600 borrowed, paid $617.46 so far

Check N Go - originally started with an online payday loan of $255 then rolled it over to an installment loan in December and they credited the $300 fee and deposited $2225 into my account so they financed $2525 to me. Paid $569.82 so far.

Spotloan - Borrowed $800, paid $112.89 so far.

Brookwood Loans - Borrowed $3500, paid $2,389.68 so far with an upcoming payment of $298 this Tuesday

I should also mention that in addition to all of that mess I had 3 storefront payday loans at the max of $255 each. However I entered into payment plans with all of them back in December and I only have one more payment for each of them....baby steps...

Great news on Plain Green - That one is done -- the store fronts will be done soon -
So on to the online ones - These two are tribal - do the same as PG.
Mobiloans - Tribal - treat the same as PG - You owe them $100.87 - payable how you feel you can -
Spot loan - Tribal - treat the same as PG - You owe $687.11 - payable how you feel you can -

Legal licensed to lend in CA - best to see if you can work out a payment plan with that you can live with...
Rise Credit - Legal to lend in CA - hope someone else can shed more light on them
Cash Call - Legal to lend in CA - Not going to be an easy one to work with at all.
LendUp - Legal to lend in CA
CheckNGo - Legal to lend in CA - should work with you ..
