Here is the response I received today from Castle Payday:

Thank you for your email. We are sorry to hear that you are unhappy about your recent experience. Our reputation is important to us and, as such, we are willing to consider the circumstances surrounding your request in order to determine the appropriate action. Having reviewed your complaint in detail, we would like to mention a few points of issue before commenting on a resolution.

We would like to point out that when you were presented and signed the Loan Agreement (which fully discloses the terms as well as the payment options) on December 26th, 2012 at 10:06 AM from IP XX.XXX.XXX, it was your responsibility to read the terms and conditions.

Please be advised that Red Rock Tribal Lending, LLC (D/B/A Castlepayday.com) is a Tribal enterprise, wholly owned and operated by the Lac Vieux Desert Band of Lake Superior Chippewa Indians, a federally-recognized Indian tribe and sovereign government (“Tribe”). Because the Tribe regulates its own consumer financial services pursuant to Tribal law, state licensure or regulation is unnecessary and inapplicable to the Tribe, and, by extension, Red Rock Tribal Lending, LLC.

Notification was sent to your email address at the time of funding approval, as well as prior to each and every due date, in which specifically details in bold the auto renewal policy that is about to occur and the payment options available. You have submitted your complaint from this same email address therefore, confirming you have in fact received the approval and renewal emails mentioned above.

Our records indicate that your current balance is $1,406.25. This includes the Principal amount of $1,125.00 plus the Finance Fee of $281.25.

Having stated the above, we understand that many people are experiencing difficult times. So, while we are not obligated to do so, and in full and final settlement of your grievance and any claims you may wish to assert against us, we will agree to the amount and schedule below. Once all the agreed upon settlement payments have been successfully paid, we will waive the remaining balance on your account. Agreeing to this settlement will freeze any interest or fee amounts currently outstanding.

Although we do accept Money Orders and Cashier’s Checks, we strongly recommend that you select ACH transfer to prevent any issues that may result from an untimely or lost payment sent through the U.S. postal system. Please notify us if you would like to use a payment method other than ACH.

To finalize this settlement option, please reply “I AGREE” in the subject heading of the email. You hereby voluntarily authorize us to initiate automatic debit entries to your Bank Account in accordance with this Agreement. Only upon receipt will settlement be made.

Hello, sorry to being back old thread. I have loans at Castle and Blue Trust. They each have a demand draft (Remotely created check) feature built into their contracts. I have revoked ACH, and have revoked the authorization for remotely created checks. They acknowledged the ACH, and sent the same email response as the OP here. I have not yet agreed to the terms of their "deal". They are threatening sending to collections (It's been a little over 30 days since last payment was made to each.). Has anyone had experience with either company, or any company for that matter, actually attempting a full balance remotely created check or telechek? Thanks

I dealt with CastlePayday before and they were the "hardest" to deal with out of the 7 PDL's that I had. If you send the letter that Soaplady has created (stickied in forum), they will send you a bs letter about them being tribal. If you just wait like a week and resend your response that you are not paying them, they will eventually create a "settlement" plan for you. Personally, this is the only "settlement" plan I accepted as it was worth $100 to just be done dealing with them, even though I overpaid. All of the other companies just closed my overpaid accounts.

tell them to take their offer and shove it.in fact demand a refund stating that since it is tribal it is illegal,and therefore you will not pay another penny.

Thanks for the advice. I need to wait until my account closes (5/8) before I make any moves. Don't want them to retaliate and take money out of my account.

good luck im in the same situation with them ive sent 6 emails back to them and they keep sending the same settlement and saying there sending it to collections i told them to go for it and that since they dont want to agree to my terms, they will not get another cent from me

Almost a week now id say, and its the same emial from them everytime, just with more payments, but it still equals to the ammount there trying to get

Teacher - I am a teacher too. I had 7 PDLs. Its been a month since I sent them the letters. None have called my work. Plain green and east side lenders called my home number for about a week, then stopped. All but castle payday and western sky have sent me PIFs.

Great hearing from a fellow educator. My biggest fear is getting calls at work as there are lots of busy bodies. I have 4 total and have paid back the principal on two accounts. Hoping to pay off the other two soon and have them all marked as PIF. What state are you in?

So in addition to sending the same e-mail they sent last time with the agreement they also included this paragraph at the end:

If you chose not to agree to the proposed settlement, you may send a letter to the Tribal Financial Services Regulatory Authority. If your letter is not received within ten (10) days, the full balance of your account ($1,406.25) may be sent to a 3rd party collections agency. Please send your written complaint to the following address:

Do you think that they will really do this since they are tribal and illegal? How long would it take to go to a collection agency?

It depends on the lender. May take a few days or a week or so. Just remember that you can send the CA a cease and desist via certified mail, return receipt requested which will give you the signed green card to show when it was signed.
