Can you be arrested for a defaulted payday loan?


Debts are civil, not criminal. Nothing can be done to you. This is a typical scam. Simply ignore the calls. If they persist, report them to your state's AG and the FTC.

If you are in California, he is handing you a complete load of BS, as you can NOT be arrested for defaulting on a PDL. If your loan was legal, however, you can be taken to civil, not criminal court. Most storefronts in California are legal, and if you did loan with a legal lender, it would be smart to work on payment arrangements ASAP with the lender directly. Do NOT give these sleazy collectors any of your money! If your loan was illegal (probably on-line, but we can check the license status), then you can tell them to get screwed. We recommend that you do pay the principal (what you actually borrowed, since you did have use of the money) and not pay any of the fees or interest.
If they persist in calling you, report them to the California Dept of Corporations.

I defaulted twice on an online payday loan. The first time was with the actual payday company themselves, the second time was with the third party collector. The actual company no longer exists as their original name, they are now Cash Central, and the third party collector (Lewis And McCarthy) sent my account to national process servers and they gave me the number to Ross Klein Capital Managements. The Ross Klein Capital Managements never contacted me, they contacted my ex fiancee threatening to sue her for the money I owed because she was put as a reference, then they called my mother under the name of Investigator Abrams, and he said I had a federal warrant out for my arrest, and he gave her the number to Ross Klein Capital Managements, claiming it was his cell phone. When she called they told her that I was bouncing checks, which is a lie because I never wrote either of the companies a check. When my mother asked how they got her number, they said I put her as a reference, which is also a lie because the Cash Central loan company only asked for one reference, which was my ex fiancee. I called the Ross Klein Capital Managements company, a woman answered with such a kind voice, I told her I was calling in regards to a case, she told me to hold on, put the phone down, and she picked up the phone again with a mean demeanor, and asked for my case number. I gave it to her and she became real rude claiming I had bounced checks, and when I tried telling her I didn't, she kept going on about how I bounced checks and how I owed the money. When I told her I didn't have the money but I was willing to try and get it, she said "Well you've already defaulted twice, why should we trust you?" I tried negotiating but she interrupted me and repeated herself. I then told her "Look you can either wait for me to get the money, or you can take me to court for money I don't have" She then said she was putting me down as refusal to pay and that she was going to take me to court, and recommend the maximum penalty which resulted in me paying everything (court fees, attorney fees, actual loan, etc.) which would take the loan from 700.00 to over two grand, then said good luck, then hung up. I have a couple of questions. One: If I never wrote a check, can they say I bounced a check? Two: Can they threaten me with a federal warrant? Three: What are my options against them? Can I countersue them? I know what they are doing is illegal and their collecting tactics are scare tactics, but I just want to know exactly what is going on, so I can figure out the best way to approach this situation without making a mistake.

Payday loans are illegal in NJ, as I have been told many many times now. Tell them your the contract is not enforceable according to your state's laws. Also tell them you can't go to jail for debt! The "bad checks" they're talking about are probably the EFT or telechecks they were trying to draft up with your electronic signature to try another method of taking the payment from your account. Have you paid back anything towards these loans?

The guy on the phone said it was like "check fraud" because I gave them my banking information and when they tried to take the money out the funds were not there .... is this true? I cant go to jail, i wouldnt last 5 minutes

First off you are not a stupid 20 year old. Debts are civil, not criminal. You cannot be prosecuted. Ignore the calls, stay off the phone. If the calls persist, report them to your state's AG and the FTC.

i made 3 payments as agreed on my loan but when i got the loan i wrote them 3 checks in case i did not pay . i ran into some tough times and did not pay and they ran the checks several times and they would not clear now a guy from georgia is calling me in texas threatinig to have me served then immediately arrested! he called my boss and asked him what the process was with our company if we were getting served? wow what an embarrassing situation what do i do

Even if you get a pay day loan for 1,000 and then close your bank accounts,I don't think it's even a criminal issue. Even so if the lender is out of state they are out of luck even in state the process depending the state can take forever. If they are calling you more then a year later your not gonna get arrested.

They have to proof fraud is involved,what happens if you had a legit reason to change or close your accounts. These people are scum and breaking all kinds of law,record them slipping and you could probably sue them for breaking the fair credit act law. If collection agency called send them a cease and decease letter then if they still harass you can have a law suit. Most places aint gonna sue for even 1,000 all they really can do is bother you and tell a bunch of bs and maybe put a mark on your credit report.

I see, well I would try to work out something to pay back the principle. I've been told on this site that you can repay the principle on your own terms, only as much as you can afford, because the loans are illegitimate in the first place. Today I already had success with Plain Green Loans settling for JUST the principle. So they knew they were in the wrong, they didn't even argue with me.

No, I have not paid anything back on the loans. I lost my job right after taking out the loans. And I'm sure the bad checks they are referring to is when they tried to debit my account and it was returned for insufficient funds. But that's still a crime I believe.

Hi I would like to know what happened in your case. I also defaulted on a payday loan back in 2003 and now live in Florida. I am receiving nasty and threatening emails from a so- called officer that I am going to be arrested.

I have people calling me from attorney offices out of state saying they represent the company and its starting legal procedures to have me arrested for deposit fraud. They are wanting me to pay them with no documentation to back up their claim. They said charges will be filed in my county and I'll be arrested. I'm scared what do I do??

Got a call today for an unpaid payday loan... it's late by 3 months. The man gave me another number to contact and said if I did not call immediately that I would be arrested. He said officers would be going to my home and to my place of work (he did know my address and my place of employment) to arrest me. I called the number and told him I did not have the money right now and he would have to wait until Friday. He told me he wants me to call him on Friday and that I should go to my nearest family dollar and buy a vanilla reloadable money card and place the money on there and then scratch off the back numbers and read them to him via phone. IS THIS A SCAM?? AND CAN I BE ARRESTED?

an ACH debit is not a check so the only lawbreakers are the pdl/ca that is threatening you.again you broke no laws here.

hello
I screwed up n paid a payday loan via phone today. It was from years ago(2008) but he didn't know exactly the payday location just the amount. I canceled my debt card bc I got nervous. Once I looked the company up its called Turning Point Solutions. They recorded me saying I was making this pay off amt. My question is can I get my bank to cancel the amt. Until I see the paperwork. I even asked the collection agency to reverse it until then. Of course that was a joke. O they also said well send a release form for you to sign stating you won't stop payment. That's the only thing that gives me hope. Please answer asap bc n the as soon as my debit clears I want to file a claim asking my bank to gv me the money bk. Normally I'm not gullible but n my mind I was trying to right a wrong but did something very dumb. Thanks in advance.

I have a company by the name of Alliance Capital calling my job and leaving messages with whoever answers stating that they are a processor and that they are going to have me summoned for a bad check charge for an internet payday loan that I defaulted on. I called them back and told them to send me proof of what I owe and I even agreed to made arrangements to pay (once they sent me proof) which they say that they cannot at this point. They claim that they are an attorney;s office and that the lender was The Cash Line.com. I live in Florida can someone give me some advice please.....

I have someone calling me saying that I owe $5000-8000 on a loan online..which I'm sure I only got a lona for $300 and I'm also sure I paid it as well..but they also know my name and SSN and street address and email..can they arrest me for that? They also said they don't except payment plans they want the full amount. So I didn't call back and then a 911 number called me..can they do that? They keep calling me none stop.
