Can Payday loan lenders garnish my wages?

Can you please tell me if these payday loan companies are able to garnish my wages? I have made an attempt to make payment arrangements with them due to financial hardship and they are threatening to sue me. Are they able to also serve me papers to take me to court or how does the process work?

Welcome to the forums.

As you have taken a payday loan, you are in an obligation to pay them at the earliest. This gives them the legal rights to take actions if they want to. But in my opinion, they may not do so if you are willing to pay the said debt. Taking the matter to the small claims court will not help them in getting the money faster. Plus, there are other court costs involved in it.

Your best move will be to negotiate with them for a reasonable payment plan. Tell them that you are experiencing a hard financial situation and you are concerned to pay more to the stated amount after your financial situation improves a bit. You can be able to make an arrangement only if they can sense your willingness to pay the debt.

They should not threaten you with legal actions unless they are actually doing so. Before that you will be served summons and it is important for you to respond to it. Make sure that they have to serve you legal papers and you don't' fail to appear in the court. Otherwise, things will take a negative turn.

So, just try to settle things outside the court. Advance them some money along with the payment proposal. You have to give the best to your negotiation so you get positive results. 90 out of 100 consumers are able to arrange payments. I am praying that you will also become one ending with positive results.

Thanks for your help roxette. I am trying to get out of the payday loan cycle and will never do this again. I have learned my leason. They have been calling and telling me that I have committed fraud, however, I have sent letters to them stating I would like to set up payment arrangements to pay off the outstanding payday loan. Garnishment of wages would not happen until after a court appearance if necessary right?

If they end up suing me would someone show up at my house to serve me papers??? I have never been sued and hopefully it does not come to that. I am trying hard to negotiate with them on a payment plan arrangement and some of them are telling me that I have to deal with their collections department now. Is there a period of time that collections will work with someone before they go to small claims court filing?

Wage garnishment is not legal if it is not in writing. Moreover, there are some other points also that determine the lawful aspects of garnishment. Read your agreement contract and see if you have not signed for any wage assignment. Wage assignment is voluntary and for this one, you won't be served any papers. However, there are some requirements for a wage assignment to be termed as legal.

Have you contacted the collections department for this loan payment? Your negotiation will become easier and effective if you can advance them with some money. You won't have to face the court if you can get successful results.

How do you revoke a voluntary wage assignment? By writing to the creditor? If they won't give you an address (Sonic), how can you do that? Also doesn't a voluntary wage assignment have to be in writing and not an electronic signature? Can I revoke a voluntary wage assignment by just writing my payroll dept? Thanks!

I recently took out a loan with abc payday loans. I received a call today saying that they were going to garnish my wages from my paycheck. I have only missed one payment do to some financial hardships. My intention was have the next payment debited from my account. I don't have any money to give them at the moment. I do know that I will be able to pay the missed payment and the one that will be do. Are they able to do this. I don't won't any trouble I just want this thing resolved!! Any advice?

Yes, they can but the have to actually sue you first and get a judgement from the court...then get a ewo (earned wage order) .........they will not turn down your money when you got to pay....they have to accept it. Quote:

The others are correct about a garnishment, there must be a court order first, however, more and more payday lenders are placing a paragraph in their original contract which states if the borrower defaults they agree to allowing the lender to use a wage assignment. A wage assignment and wage garnishment are two totally different things. As stated by other members, a wage garnishment requires a court order which means there would need to be a court hearing first. The wage assignment doesn't need an order from the courts, it only needs the signed signature of the borrower in the original contract, the good news is a wage assignment is revocable! To be on the safe side, if I were you I would either email or send via the mail (certified return receipt requested) asap to the lender like the one below, then take a copy of the letter to your employer! The lender will not be able to use the wage assignment once this is done. Just keep in mind though, they can still sue you and attempt to garnish your wages, so it would be in your best interest to make payment arrangements with the lender. By the way, is this an Internet or store front lender and what state are you in?

They can only garnish wages with a court order, otherwise, they are probably talking about a "wage assignment". What most online payday lenders do is sneak in a page in their contract which states you will allow them to attach your wages if you default. The good news is, it is revocable at any time, this means all you need to do is shoot them an email and say you hereby revoke their right to use the wage assignment, then, take a copy of the letter to your employer.

I recently made 5 different payday loans that I am unable to pay back I am obtaining a lawyer for bankrupcy can these pay day loans still take me to court and can they garnish my wages also are they allowed to harrass me at work. There are a few of the loan companies that I cannot find addresses on either they may be third party companies is there a way to find their addresses?

names of each pdl
amount borrowed from each
total amount debited prior to default

contact the maryland DFI(dept of financial inst.)they will confirm that none of these can do what that letter or calls threaten.

I need to send letters but cannot get addresses for Qxl and Integrity do you have their addresses and are they legal what are my rights if they are illegal I live in maryland and am in the beginning process of filing bankrupcy.

I am dealing with a pay loan colection agency that claims I took out a loan with them but my bank have no record of the money coming in or fee going out of my account around the time period that they gave me. I dint remember taking this loan out but they have all my info and references what should I do.

First of all, never admit to owing a debt, or make payment arrangements to a voice on the phone. What is the name of this collection agency? Tell them they need to send you a letter of collection via the mail as required by federal law (FDCPA).

Hi, My wife has been in debt settlement program for about a year in half she has now recieved documents from the courts saying chase is going to garnish here wages now she is not going to afford to pay the settlement company or pay the garnish wages what do we do next ? what can the settlement company do for us?

First of all John, cancel your settlement program. I was with Freedom Debt Solutions from November 2011 to February 2012. They never paid any of my balances on my credit cards which hurt my credit score a lot. During that time I was with them, I cancelled both credit cards and things were tight so I made the mistake of borrowing from many of those payday loan companies. It got to be so much that I was unable to pay them back and so I had to close my checking account because of the automatic ACH from my account and re-open another one. I am currently in the process of bankruptcy. I would check with your local bank to see what they might suggest.
