I live in florida and have defaulted on several internet pay day loans.

Second payday loan with ameriloan $250.00 amount paid $300.00

Second payday loan with CashNetUSA $500.00 amount paid $387.01

Loan with Sandpoint capital $200.00 amount paid $720.00

Loan with Jd Marketing Group $200 amount paid $240.00

I have also already sent letters stating that i revoke all debits from my account and these companies are still debitting. What others rights do i have?


The company goudah posted will be licensed/legal. One company listed is illegal/unlicensed. I'm not sure of the others, if they are licensed/legal. I'm going to post your Florida state pdl law for you so you can see it. However, let me first tell you that sending the letters revoking debit authorization will not prevent them from debiting. Mainly the illegal pdl's will continue to debit regardless. In this case, the best thing to do is to close your bank account and open a new one at a new bank. There is a sticky at the top of this site page regarding closing your bank account. Read that carefully. I know ameriloan is unlicensed/illegal. I haven't heard of the others. Hang on. We'll have a florida person here soon! Hang on! :D

I don't know about Sapoint either. ameriloan is illegal as Cannr says. Send them a letter requesting they mark you account paid in full citing Florida's laws. They are a company that goes 50/50. %0% of their clientele they will agree with without a fuss, the other 50% they argue with and continue trying to collect their money (or at least what they think is their money, but we know is illegal interest and fees).

Apparently Sandpoint Capital is HIDING. After doing a google search, I did find a telephone number and a fax number. However, nothing comes up under the name or telephone number. Are they using another name, by chance? Anyway, here is what I found:

i got a call at work today from a collection agency susposely but i didnt talk with them. Well i looked at my loan documents from sand point and found a address for them from the west indies. I will be sending a letter to ameriloan with the paid in full request and see what happens. I also got a call from a lady at cashnet and she couldnt set up arrangements that i could afford, but she did give me the western union/ money gram info. So i guess that i will send them what i can

ibed, what address do you have for Sandpoint in the West Indies? If it's an illegal overseas pdl, you're more than likely going to have to type up a very fast letter revoking any wage assignment you signed with them. Does it state a name other than Sandpoint Capital? And what is the address?

ibed, I can not find one thing on this company. For your own safety, just to play on the cautious side, send them a letter revoking any wage assignment you may have signed with them, their partners, or any affiliates. The illegal overseas company's are the ones that are notorious for doing wage assignments. Just to be on the "safe" side, type a letter revoking any wage assigment you may have signed. Fax it, email it, mail it certified.

ibed, better safe than sorry. I would rather revoke something that didn't exist than risk the chance of not revoking anything and then it pops up one day 4 months later. :wink:

ibed, it's a "waiting game" now. Is your bank account closed so that they cannot hit it with debits any longer? If it is indeed closed and their debits will be rejected, it sometimes takes them awhile to figure that out. They're kind of slow that way. Once they realize they can not hit your account any longer, they will contact you. They may just not have "clicked" yet that they're not getting their debits. Once they realize it, they will contact you. By God, they will call, email, whatever. Did you close your account? And have you filed complaints with the BBB, the FTC, and your state AG yet?

Just a update
Sandpoint capital called me today they agreed to give me a refund of over payment and contact the collection agency to remove that with them. They faxed me paper work to my job and i did keep that copy including the cover sheet. I still havent talked to the other places.

ibe, great news on that sandpoint one (or whatever the hell their name is)! That is great! Make sure you keep copies of what they sent. Keep them and take them to the grave with you! As far as filing your complaints, you can file with the Better Business Bureau (www.bbb.org). You can file with the Federal Trade Commission (www.ftc.gov). And you need to file with your state attorney general. I just did a google search to find mine. I put in (my state name) attorney general. The site came up. Look under Consumer Protection. Then there should be something called "File A Complaint". States are different. Some you can file on line, some you have to print out the complaint form and mail it in. Just depends on how your state attorney does it. Whatever they want, just do it. You can file the BBB and the FTC on line. If you need any help, just post! :D

Forget revoking. Balance your checking account. Walk in to your bank. SMILE. Close your bank account. Now go to another bank or credit union and open a NEW account. OR find a local place who sells or gives free money orders. Always pay SOMETHING. Even $5.00 is a payment. With money orders, there is nothing they can do but CASH it, which shows you are trying and judges like this, should you end up in court. BUT....EVEN BETTER...If you are self employed, open a Nevada corporation, which can be so very helpful. It doesn't even matter if you live in Nevada. I live in Florida, but all my self employment is under Nevada law. I am an S-Corp. If someone does try to sue, you are basically a bulletproof target LEGALLY. You basically become a person who legally has no assets and LOTS of protection from a business stand point. Find a way to become self employed. I have done Real Estate Appraisal, Real Estate Broker, Assessing, and the last 10 yrs. and Insurance Agent, which I still am doing. If you end up in court for any criminal or civil action, the judge wants to know ONE THING. Since the people suing you want money or assets, the judge asks ...What do YOU own? This is so the judge can decide if they can award a judgement to the people suing you. BUT...if you have no assets because your Nevada corporation owns everything, then YOU personally have no assets and your LOCAL checking account is owned by the Nevada corporation. My Nevada corp. purchased and bought my car, all my computers, furniture used for business, supplies and every other thing you can imagine, but it's all legal because I am self employed. I follow all the laws and all the tax laws. I always do things correctly and honestly. When someone wants to sue for money or assets, you can bet anyone suing will have to decide how much they want to spend going after your assets. Attorneys always check to see what you own before they take a case. If the target of the lawsuit owns NOTHING, not even a simple checking account, there are no assets. Now the entity suing you has to decide if they want to pay their attorney thousands of dollars to sue you. If you have no assets, then the attorney will charge big time or not take the case. And...they will not do a CONTINGENCY law suit because a Nevada corporation is pretty bulletproof...meaning uncollectable. My Nevada corporation owns just about everything. I am not sneaky. I am right up front, but I take advantage of every law I can. When someone finds out there is nothing to take from me and they will get ZERO, they leave me alone. In addition, there is a fantastic "corporate veil" on Nevada corps which is very protective. In the last 41 yrs., only 4 times has the "corporate veil" been pierced in Nevada, meaning there was a loophole found. In comparison, in Florida there are 27 loopholes, in Maryland there are 20 loopholes. So I live here and my business partner lives in Maryland and we are both incorporated as separate corporations in Nevada. No estate tax, no death tax, no probate, no civil suits, and it goes on and on and on. So...get to the bank and start protecting yourself. CLOSE YOUR ACCOUNT and GO ELSEWHERE. NEVER do automatic payments out of an account you can't control.

iS ANYONE FAMILIAR WITH THIS COMPANY?? I DONT WANT TO CONFUSE ANYONE ON MY ISSUE WITH THIS SCAM OF A LOAN CENTER..BUT....IF U'D LIKE...U MAY GOOGLE "SGQ PROCESSING" AND YOU WIL GET A MUUUUCH BETTER UNDERSTANDING OF WHATS GOING ON!! i have a question i default my payday loan with sand point capital and they called me asking me to pay it back. they told me they was going to get me for writing bad checks n take me to court and put me to jail or take it out of my wages is that true can they do that becuase i was to give them money and they was going to take it out of my acct like check form is right can they do that lisa
