Multiple loans in Alabama...success!

Hi guys. I wanted to let you know about my situation in Alabama. I had multiple pdl's recently. I had about 9 out at one time equaling about $3500. Here they are:

Greenpicket.com- 950
United Cash Loans- 300
Ameriloan- 490
BLVD Cash-490
StoneCanyon Lending-425
Sigma Solutions-289
Dollar Premier-625

This was getting unbearable paying them every two weeks for the past few months. I started following the threads in this board and took advice I read.

I have received paid in full on all accounts except for 1 that I still owe the premium on.

These lenders are all illegal in Alabama. Thank you all for giving the advice on this board. Lifesavers!


Yes they are working with me. I told them when/how I could pay it off. They had a little push back at first, but they ended up accepting it.

I too live in Alabama and am dealing an illegal lender MyCashAdvance. I sent the ACH letter you suggested in the how to deal with illegal lenders. I agreed to pay the prin owed. This is the response I received from them,
Dear Carol,

Thank you for contacting us.

Please note that the laws you are referring to only apply to loans made by
private citizens and companies.

You borrowed this money from the Oglala Sioux Nation, a federally recognized
Indian tribe. According to both federal laws and our treaties with the US
Government, we are not required to follow any state’s laws.

We only have to obey federal law and the laws of the Oglala Sioux Nation which
we have done.

If there is anything else we may do for you do not hesitate to contact us again.

Typical response from an illegal lender....keep sending your email regarding paying back the principal amount borrowed....if they don't abide by your wishes, no money to them and their loss. Good luck!

Okay mycashadvance withdrew from my account with i have sent them an ACH revoke. It forced my account back open, but th thank goodness my bank is refunding me the money and place a hard freeze on the account. Mycashadvance hit it for 3 times as much of the owed balance.

My question is they are claiming tribal, but since they are being rude and down right theif's... I'm not paying even the principle owed. Can I do that?

I am filing complaints with my AG FTC and Banking department.

You can do that but we do not condone not paying back the principle owed. Why have you not closed your bank account and opened a new one not linked in any way to the old?

Sorry, my last post was not clear. The bank put a hard freeze on my account due to direct depoist not completed. I opened a new account. The old account was forced open due to a bank imposed fee. My direct depoist hit and MyCashAdvance was able to ACH, but since it was the banks fault they reversed the ACH and refuned me. The account is now closed.

I do intend on paying the principled owed it just ticks me off that MyCashAdvance is ignoring my ACH revoke.

Advice? Should I send payments by money order and mark paid in full for principle paid without MyCashAdvance agreeing to the principle only? or should I just keep sending letters until they cave in and accept and then send payment?

BTW- Since find this site I have 8/10 loans that are either marked paid in full or they have accepted to principle only. So THANK YOU to all that have posted advice and help. This site has saved my finanical life.

Thank you for your response and stating that my State Laws do not apply to MyCashAdvance.

Thank you for also pointing out that the money is from the Oglala Sioux Nation, a federally recognized Indian Tribe. This sparked my interest to research laws and sovereign immunity (assuming this is what you meant to say). If you are indeed a member of the Oglala Sioux Nation then you must know the definition of Sovereign Immunity, just incase you don't Sovereign Immunity definition is-A legal defense to a court action granted to a sovereign tribal government and its entities that prohibits a lawsuit against itself, its entities and its employees unless the
defense has either been abrogated by the United States or the Tribe/s has expressly waived its immunity. Now then you can choose to sue me, but in order to do so you must waive your Sovereign Immunity for that issue, which is oline payday leanding and if you choose to waive your immunity then you will be subject to My State Laws regarding payday loans and set a presidencies for other states that govern online payday lenders.

As stated in my previous emails, I am willing to pay outstanding principel only ($370.00) and I will do this in monthly payments of $50 until paid in full. I will be paying by money order only. In order for you to receive my payment you must send me your payment address.

I just want to be clear that this was posted in my preivious email and I expect you to honor my request;

Be advised that as of today, Saturday, August 2nd, I am revoking ANY and ALL ACH authorizations with your company from debiting any AND all of my personal
accounts, per Federal law, Regulation E Section 205.10 Preauthorized transfers. I have given a copy of these revocations to both my bank and my employer. Any
future attempts to collect funds in this manner will be blocked. I also revoke ANY and ALL wage assignments I may have signed, including but not limited to; any of your affiliates, dba's, and collection agencies assigned to this account. None of the above no longer have my permission to access my accounts or impose a wage assignment.

I will only communicate to resolve this matter via email. If you ignore this notice and attempt to contact me or any of my references via telephone, you will be ignored and any payments owed will be delayed. I am willing to pay the
principle amount of the loan only, however, no address means NO payments, this is not negotiable.

If you send this account to a third party collections before the loan is paid in full (principal only) I will issue a Cease & Desist. I will then file complaints with the FTC, AG and Banking Department.

Be advised to govern yourself accordingly.

Is this okay to send?

Due to security reason we are not allowed to discuss full details on accounts via email. Please call our recovery department (877) 314-6571 ext 5413 at as soon as possible. Your agency Ms. Sherman will be happy to help you.

What should be my next step?

A load of crap...do not call recovery dept...keep sending email that you will only discuss via email....if they won't do this....then too bad! Remember you are in control not them....have to laugh due to security reasons cannot discuss....

I thought the same thing. I'm this whole thing was done on the internet, so why now is it a security issue to lol.

Have pay day loan with them as well froze my account then lost my job i have paid them $175 miss hubbard keeps threatening me with fraud and arbitration I live in North carolina payday loans are illegal here and suggestions what to do?

If yes.. then you are done, Until they agree to your payment terms on the principal balance. .. How much did you originally borrow? I see from above that you paid them $175, is that the total paid to date?
