Hi,
I am currently dealing with three different pdl companies. I have made payment arrangements with two of them but the third is still sending me threatening emails. I've just learned from reading this board that this is illegal! I have also found that they may be debiting my checking account illegally. It seems that they are using two different names to debit my account. One is DMS Marketing and the other is Check Recovere out of Kansas City MO. I'm sure more information is needed, but can anyone advise me on how to handle this?

Good to hear that the payment arrangement with two loan companies has already worked out. Now you have to arrange the same with the third one also. But it seems that they are not willing to work with you. Since you have already authorized them for the debit while taking the loan, they should not do that prior to the due date. Make sure, you have money in your bank account, in case they try instead of working with you.

At this stage, don't close your checking account because you don't have much proof of their illegal actions. They have threatened only, not debited your account in illegal terms. If they do that before the set date, you will have strong reasons against them.

Explain your problems to the bank. They can keep a check over this company and notify you in case something unfair happens. However, it will be good to call them directly and resolve this matter. Have you asked for the latest statement of your loan account? You must pay only the principal amount along with the interest charges fixed by your state. Some companies tend to do some illegal things by charging excessive fees. Don't get victimized on this issue.

Jeaniem3, are they both debiting your account on the same date, or are they alternating? If you have not authorized a sister company of theirs to debit your account, you may have some extra standing against them in addition to what Christina posted. Bank don't like fraud, and if you suspect that both of those debits are going to the same company (and your being debited twice for the same thing) alert your bank to the possible fraud situation. Some banks are even willing to do a trace on the debit to see where the money goes, and this could definitively tell you if what you suspect is true.

Thanks to both of you! First of all, I did make payment arrangements with DMS. That was on 08/04. On 08/05, I received an email with this subject:**URGENT ALERT - Delinquent Loan Under Review!!
Dear Customer,
This letter is a notification of your outstanding cash advance balance with Westbury Ventures/PD6 Ventures/Express Cash (and/or its affiliated companies) and the further action pending to unsure this matter is resolved in a timely manner. Funds were loaned to you in good faith based on your promise to repay them as you agreed to in your loan contract. Currently, a number of finance charges and late fees have accrued on your balance. It is my desire to work with you to reduce this balance and prevent any reporting or other further actions from being taken. I am more than willing to discuss this matter with you and, depending on your timely response and cooperation, offer you a settlement on your current balance. These settlements can save you between $30-$300 and ensure that no other departments or outside agencies are involved. If you have any questions, please contact me immediately. Again, the sooner you contact me, the more you will save.

Because I had already made arrangements with this company, and because I was questioning the amount I owed, I replied that payment arrangements had been made and that I wanted to know what the total on my account was. This was the reply I got:

Ms. Johnson did advise me that you were needing to set up arrangements to
your loan and forwarded your account to me at this time you have reached the
collection department and arrangements need to be made with us. Your current
balance due at this time is $390.00 account will need to be paid within the
month so I will need you to pay. 195.00 will need to be made this month no later
than 08/18/06 and $195.00 no later than 08/31/06. I need to know the dates that
you would like the funds to be deducted.

I then replied to her that I could make these payments on 08/16 and 08/31, and that she had my bank information already.
Here's the response to that:

I have found that when talking to this person on the phone, any arrangements are disregarded. That is why I preferred email, so that I would have a record. Now I know better and will correspond by USPS. After this email I asked that she please acknowledge the fact that I did make arrangements and if there was a problem let me know (still via email). This was her response:
REFUSAL TO PAY
The difficulties experienced by the collection department at PD6 Ventures/Express Cash when attempting to obtain the slightest amount of cooperation from you have led to your account status being changed to ???Refusal to Pay/Intentional Neglect???.
Whether or not you considered it or not, borrowing money and intentionally neglecting to repay what was loaned to you is wrong. The consequences for the actions that you have taken were clearly explained in your signed loan contract. To avoid these consequences, return one of the attached authorization forms before 4:00pm CST on, July 12th, 2006 so that this balance can be cleared without further incident. Fees will be added to your balance after 4:00pm CST.

After receiving this, I called. I got her voice mail and again asked why she was sending me these types of emails. I was not avoiding her nor was I refusing to pay. I gave her my phone number to call me back, which she has not done, and also sent her another email asking that she contact me and tell me what else I'm suppose to do besides wait for August 16th to come around?
I have not authorized any sister company to debit my account, and these two companies have been debiting my account for the same amount on the same days.

First of all, I will not take a payday loan in the future. In case, if I ever have to, this company will never be an option. I understand from these emails how they do their inefficient business. It sounds awkward when they sent the last email stating that it was your refusal to pay the debt although all arrangements were trying to be done and you wanted some information first about your account. The funny part is that they are taking it to the final stages of legal actions mentioning "Refusal to Pay/Intentional Neglect" and then at the end saying "If you have already made arrangements to take care of this account please disregard this message" do they think errors and omissions should still be expected at this stage when dealing with a particular customer? This is crap. I will advise you to take some legal help here. You tried your best but this company is a pain.

justme...believe me, I've learned my lesson! I borrowed money from Check n go once and that was so easy and efficeint I thought they were all like that! I was really in a bind at the beginning of the year I thought this was my only option. WOW...what a huge mistake. It got me out of the original bind, but it really took a huge toll on my finances! I'm starting to get out from under it now, and as I said I've made arrangements with two and no problems there. But these people are really starting to annoy me! The first person I spoke to was very pleasant and more than willing to work with me. But somehow I got turned over to this Christina Hampton person and things went down hill from there. Well, like I said, I'm going to do everything by USPS from now on! I plan to send the letter I copied from this sight and ask for validation of the account.

Has anyone heard of Expresscash/loans? They tried to debit my account today, and I have a sneaky feeling its DMS trying to get around our agreement! I've gone thru all my records and have nothing from expresscash/loans. And of course, since they tried to take out more than we agreed on, it bounced! How can I find out for sure who these people are?

Hi, I am dealing with a Ronal Reynolds from DMS Marketing/Westbury Ventures/PD6. I paid $155 toward my loan already, I set up payments. They took one payment then he called me and said their attorney said they couldn't take any more payments from my debit card, that I would have to go to a Moneygram at Walmart. I didn't do that. That was 3 months ago. Now, yesterday, he called me saying that my balance was up over $800 and that if I didn't pay $355 by Jan. 29th, they would pursue me and a warrant would be issued in my county and this would be a felony for check kiting/internet fraud. He asked me if I drove and if I had kids..?? IS this true??? Can I be charged w/ a felony for not repaying ALL the loan back?

I too borrowed $300 from this company. I wanted to pay the debt in full, but couldn't find their website or a phone number to contact them. My bank couldn't find any info on them either and told me to close the account. I did and have got the same emails that others here posted. I have paid the debt back with all their $90 charges every two weeks. This company contacted me through my bulk mail with yahoo. The PDL company I choose to go with in an emergency in cashnetusa.com They contact me a week before my payment is due and give me other options. They also have contact numbers and a website to get in touch with them, How bout that!!! Dms is a scam and please help others by staying away from them. By the way, their latest email says they are going to contact my employer for fraudelent information. It's just a scare tactic, please don't be fooled by it.

I saw your post regarding your suspisions that DMS Marketing was taking the money out of your account under the name of Check Recovere as well. Did you ever get a resolution or more information on this? I am all of a sudden getting debits from check recovere as well, which is not a company I have ever taken a loan from. I checked them on the internet and it seems that they are corralated with DMS Marketing. Any info would be helpful.

i tryed to get a loan i sent this company my check stubs they got my account number of the stub and now they been trying to take money out i have 239.00 worth of fees the bank is trying to work with me to see what they can do

Yes I too fell into the trap of payday loans, especially the online variety. I notice that on my bank staements that there is no phone numbers to call these people. So I have decided to consolidate my debts and have spent the money to issue stop payments on all electronic transactions. That way they will have no choice but to contact you. If they don't want to work with you in this way then tough, they will so they can get paid. I will never take out a payday loan again.

You need to file a complaint with your state's attorney general's office, ftc, and bbb in Kansas City Missouri in regards to their business practices. I bet you they will be signing a different tune after those agencies get ahold of them. I know for a fact as I have dealt with them in the past.
