judgement filed by a creditor/collector

i am paying on a debt that the creditor/collector has now filed suit for judgement. Should i appear in court or not and will being present and stating that the account iwas and is being paid on not get the judgement filed against me?


I was and still am paying on a debt that the creditor/collector has filed suit. I call and ask why a suit was filed and they say that the amount would not pay-off the balance in reasonable sufficient time.
He then suggest a higher amount that i agree to pay monthly. After which I ask, Will a judgement still be filed against me? He says unless you pay the debt in full before the trial date it won't. I was then informed that I need not be present for court but it would be strictly my call but the judgment will still be requested wether I'm there or not. Is this true?? can I produce evidence in court of payments made and request that a judgement not be made against me?
Please advise.

Hi,

You don't have to be in court, but I would reccomend it. It's a good idea to know what's going on.
Unless you pay the debt in full before court, the judgement probably will be filed against you. Sometimes the creditors can be convinced to drop it..Make sure you get it in writing if you can convince them.

who is the creditor and how much do you owe. I was able to get them Citibank to drop mine from $1069 to $450 by sending a letter to their lawyer explaining my hardship, backing it up by asking them to run a credit report on me which proved my case of the fact that I may be declaring bankruptcy and they agreed to $450 and i paid it and the case was dismissed. so how much do you owe and who do you owe it to.

From what I understand: You are paying on the account, but not enough to make them happy. Am I right? If you are paying them already and they still file for judgment---GO TO COURT. PROVE you have been paying all you can in every effort, way, shape and form and chances are Judge will toss them and the judgement out the door!

If you chose not to go to court, they will grant the judgement by default. You don't want that. Because the next step is to collect their money by garnishment or freezing assets.
