There are a few letters out there, which one were you referring to? Most all letters will work, you would just have to tailor it to your needs.

You can ask the original creditor for a detail accounting of the transactions in your account at any time. Most creditors are more than happy to do this on a verbal request.
'Debt Verification" as you see used in these form refers mainly to verification/validation under the Fair Debt Collection Practices Act, which, with a few exceptions does not apply to original creditors. Many Original Creditor may choose to Adopt the fdcpa as a guideline or policy, however they are not legally required to comply with it.

Try this letter when you are disputing with the original creditor. If the creditor has hit any remark in your credit report without genuine reasons, ask them to verify the details. If the creditor fails to provide you any document that discredits your dispute, the item must be removed from your file within 30 days. It is as per the laws mentioned in the FCRA. Send your dispute through certified mail with return receipt requested. This will ensure not only its delivery, but you will have documented proof about the letter sent to them.

Date Your Name Name and Address Of original creditor Re: Acct # 000-000-000-000 To Whom It May Concern: This letter is regarding account # 000-000-000-000, which you claim I owe. This is not a refusal to pay, but a notice that your claim is disputed. I am requesting validation, made pursuant to the Fair Debt Collection Practices Act. Please note that I am requesting "validation"; that is competent evidence bearing my signature, showing that I have some contractual obligation to pay you. Please also be aware that any negative mark found on my credit reports from your company or any company that you represent for a debt that I don't owe is a violation of the Fair Credit Reporting Act; therefore if you cannot validate the debt, you must request that all credit reporting agencies delete the entry. Pending the outcome of my investigation of any evidence that you submit, you are instructed to take no action that could be detrimental to any of my credit reports. If you no longer own this debt, remove the derogatory marks from my credit report per the FCRA. Failure to respond within 30 days of receipt of this certified letter will result in legal action against your company. I will be seeking a minimum of $5,000 in damages for: 1. Defamation 2. Negligent Enablement of Identity Fraud 3. Violation of the Fair Credit Reporting Act For the purposes of 15 USC 1692 et seq., this Notice has the same effect as a dispute to the validity of the alleged debt and a dispute to the validity of your claims. This Notice is an attempt to correct your records, and any information received from you will be collected as evidence should any further action be necessary. This is a request for information only, and is not a statement, election, or waiver of status. Best regards, (Insert your name) Cc: (Insert a lawyer's name here), Esquire |
DEBT VARIFICATION LETTER
So, you are suggesting I send this letter to them instead of making any payment arrangments since I paid them way to much money? I live in Arizona not sure what all the laws are but I beleive they have been charging too much money for these loans. 90.00 on 300.00 and 59.00 on 200.00 If I am not mistaken based on Arizona law they can only charge 45.00 per 90.00 and 30.00 per 200.00 that is if I am correct with the law but I am not to sure. Think this letter will work since I did not sign anything? at least not that I am aware of I never returned paragon's agreement or M1ydirects agreement that they sent me in the mail.

You have to tailor this letter as per your needs with the company individually. If you need to specify a particular point with one company, you can add it in your dispute letter. Search for the payday loan laws in the AZ state legislature website http://www.azleg.state.az.us/ and highlight the link to the loan company forcing fair and legal business with you. Understand the requirements with each company and put the issue in writing.
