Well,

Today is the day.

According to a letter I received my account will be charged off as bad debt, and then sent out for litigation, since I was unable to come up with a sufficient payment.

Should I be worried about what small level of savings I have left?

Can they put a freeze on my checking account?

Should I start cashing my check at a service place / use money orders?

I realize that my checks might get garnished as well. I would just like some input regarding what I might expect due to my unfortunate situation...

What company is suing you? and for what?
If this is from a legit credit company, I'm assuming it is, then you better hop to a payment arrangement with them before they get a judgement.
After that, they can garnishee and get to your accounts to recover the monies.
See if there's any way you can work something out with them.

Send some money in advance along with a payment proposal. Make sure that you offer them something realistic and that you can afford in the future. If you put this in writing to the company before the court date, you will have something to explain to the judge before they are likely to order any judgment against you. Needless to say that your credit company filing the case has to first prove the legitimacy of the debt and you're not making the payment arrangements with them.

Dear Under attack....

First of all, I would not send any money to them at this time. I am sure that it is a scare letter to trick you into sending payment to them. These nasty people get commission for scaring the beegeezus out of you and having you fold and send in payment.

People get in jams and no way out. If your not in a debt consolidation OR debt settlment program AND if this is the only acct you are delinquent on, you probably can Negotiate with them. Call them up and offer them a percent you can afford, if they turn you down on your offer, tell them you are looking over your funds and you will call them back. As time goes by, they will be more willing to accept YOUR offer.

They CANNOT FREEZE your checking/savings account that your salary pay goes into. They can ONLY freeze your asset accts that you have for savings and etc. I would not worry about that just yet-they have to take you to court to do that, a judgement has to be granted and then there is time to appeal (it is a long process).

When it comes down to it, most will see that it is going to cost more in the end to take you to court than what it is really worth. GOOD LUCK.
