Payment Agreement with Midland

I made an agreement with midland credit management, Inc. in February, 2006 to pay off my credit card debt from when I was in college. I accepted their offer to pay off half (4521.95) of the amount by paying $1808.78 up front, then $452.20 on the 7th of each month for six months (March 7-August 7), 2006. I had the amount automatically withdrawn from my credit card account each month. In August, however, I received a letter from Midland stating they did not receive my payment and, therefore, the payment arrangement was no longer valid. When I checked my credit card statement, it showed that Midland withdrew my final payment on August 8th. It seems a little suspicious that they diligently withdrew the amount I owed on the 7th of each month, as agreed, until the final month. It seems like they did this purposely to make the payment agreement no longer valid. Do I have a case to argue this since we made an automatic payment arrangement and it was the collection agency who chose not to withdraw the money until the 8th? Any advice will be greatly appreciated. Thank you.


okay Denver, so according to everything you've said, the debt is paid off now? so in what way was the payment agreement no longer valid? are they saying now that you owe more? I'm not understanding. I am dealing with a collection agency at this time, that I have to make payments to on the 30th of every month. Once it was a couple of days late. I got a letter just like the one you mentioned stating that the agreement was no longer valid, and the full amount was NOW DUE. as a matter of fact, this collection agency IS COLLECTING for MIDLAND. I called the case worker up and she said everything was fine. THe payment had came in and everything was still good to go. Have you called the collection agency to inquire about this? I'm willing to bet the agreement was not canceled. This was a computerized letter that was sent out because the payment wasn't in on the day it was set to be in on. not your fault though. Your last payment was set up for August, correct? and its been paid, so the account is considered paid now, correct? what else were you suppose to get out of the deal? were you looking to get it reported to the credit bureaus as paid? you will need to contact the collection agency and find out what they have to say...you may also have to call midland from that point. Either I'm missing something here, or I'm not getting it but I don't see this as being a problem for you. anyone else want to jump in here? shirley

Thanks for your response, Shirley.

I haven't been able to get through to my account manager and when I get someone else they just put me through to her voicemail. So no, I haven't talked to anyone from Midland. That's why I just wanted to get some reassurance from someone that everything should be okay. I just got nervous when I saw the letter saying our agreement was void because they didn't receive my payment on the 7th. Because they withdrew the money on the 8th, I just wanted to make sure they weren't getting me on a technicality. I HOPE I'm overreacting. It's just I've heard so many horror stories about people's experiences with collection agencies...

What the heck Midland think about them? :twisted:

If Midland claims not receiving money from you by 7th, there should not have been any withdrawal by them on the 8th. Since you already authorized them to do the debit by 7th of each month, it is their responsibility to collect the payment from thereafter. Your agreement is still valid. If they don't co-operate, tell them that you will meet in the court on charges of breach of contract and false representation of the account.

Denver---just stop and take a breath. I have been where you are...only I still had SEVERAL more payments to make in my agreement with midland, when I got the same letter that you did. I freaked because an invalid settlement with them, meant that I had to pay what I owed, about $2000--right then--end of discussion, which I DID NOT have. I thought I had mailed the payment early enough that they would get it in time before the due date but it was one day late. I called them up, everything was cool and I made sure after that, that my payment reached them with plenty of time. I don't need this kind of stress! You on the other hand, were at the end of your commitment with them and they took your last payment. You have nothing whatsoever to worry about. relax. You did your part and did what you said you would do. hope I have helped. shirley
