Okay I just got another email from these F(## uped people. Here is the email. Please advise me on what to do.

You have defaulted on everything you have every said or promised. We have lost all faith in your word. At this point we will begin our collection process again full tilt. I am turning your file over to our Legal department at the end of today. We have contacted our attorneys and they are ready to pursue this in the courts. Remember attorneys on average charge between $250 - $500 per hour and this is your responsibility to pay them as per your contract. National Payday Advance, LLC will file a Legal Judgment against you along with Criminal charges as well. Being that you have signed a legal binding contract stating that our means of retrieving funds is through ACH debit. Closing your account is considered FRAUDULENT and is a third degree felony.

If you don't want this to happen make a $100.00 minimum payment via Western Union Quick Collect today by 8:00 PM. If this happens I will ensure that your file will not be set up for court proceedings.

You have made me look foolish as I had faith in your promises and no one else did. I guess they were right and we should have continued the collection process the hard way.

No way does this letter sound professional. I guess the person from the company is making a personal attack in the email. He must have had a fight with someone before writing the mail. Now he is throwing out all his vengeance in the mail.

Please tell your side of the story. How much is the loan taken? How much has been paid. In which state do you live? I need to check whether the company is licensed in your state. Give us some more information.

Arden is correct...

That is a poorly structured,and worded letter. Most
of the people that are tasked to write those are limited in education.

Furthermore,You did not commit a "Third Degree" felony as they suggest.

In addition,when you signed the "Contract" it states if there is a problem,then it would be dealt with in "Binding Arbitration",not the courts.That right was "waived" when they accepted the contract!

Gee, that's a strange letter!

When formatting a business letter, it should never mention "I". He represents the company and you don't owe any debt personally to him. He should have used "We" keeping the company norms.

The person who wrote that letter meant a personal touch in it. Roadwarrior also mentioned a very important point in his post.

Okay the history behind this is that i took out a pdl with them my bank closed my account I think I paid a few interest charges they started to call me and threaten me saying i was going to jail blah blah blah and than i figured out my rights and told him to not call me at work anymore and to stop bothering me. he stopped for a few months and has just now the past few days started to call me once again at home and at work. he told one of my employees today that I have made him look like an ass and that I have been avoiding his calls which I have cause i dont want him to call me anymore and I dont want to talk to him. I live in CA and I dont think that he is licensed in my state but Im not sure. he is mr. k from national payday.
