In march Midland Credit agency send me a bill regarding an old debt. I wrote them a verification letter (sent it certified)- They never responded or verifited the debt. However on my credit report it was put under "pending" or something like that-

Yesterday they sent me another bill...The debt SOL is out- What kind of letter do I send them so I can get this off my credit and I can get them off my back- the debt is over- the sol is out--- Help I am really lost and frustrated!!!!

Krista,

I would suggest sending a letter to all 3 Credit Bureaus with a copy of the cerified letter that you have a receipt for. Let them know that 1. the SOL has expired on the alleged debt and 2. the "debt" has never been vaildated and that you are requesting it be removed from your report immediately. Then I would contact the Attorney Generals office and the Federal Trade Commission to file a complaint. I hope this helps.

is the State SOL out or the FCRA SOL.. for the FCRA it can be reported for 7 years from the date of last activity ( the last time you made a payment or went into default, if you make a payemnt it restarts the clock). If the debt is out of the state SOL, send midland a letter stating they have failed to validate the debt, that it is out of the SOL, and hence you are no longer legally responsible for that debt, and further attempts to collect will violate the fdcpa, Be sure to include a C&D with that.

Thanks for the input-

I have looked and looked- and have midplaced the signed thing from the certified letter- I do have the copy of the letter saved on the computer-

Since I lost this recipt, should I send another validation letter so I have proof or should I just send a letter saying the debt was not validated and the SOL is out. Does anyone know of a formate for this type of letter or specific info I should put in it?
