I want to get an opinion on letters i'm sending to my pdls, I read a post somewhere and somebody had success with them, a few listed are one's i'm dealing with now. I used the settlement template and added what was necessary for my state. just would like some opinions.I don't know how to post the letter. I took out all the personal info. Thanks!

As of today, September 4, 2006, I do not authorize xxxx, nor any represzentative, parent company, affiliate, or subsidary of xxxxx to withdraw any funds from the checking account under, xxxxxxx, acct. # xxxx, bank name and address.

Your company is in violation of Ohio Revised Code Ann 1315 et seq.(gave text here) And Ohio Consumer Proctection Law1345.03 by committing "Unconscionable consumer practices".

Your claim that the contract I signed is only goverened by the law in which your company resides is unsubstantiated. Your company solicited, accepted, and transacted business with a citizen of Ohio. Thus you are subject to the laws of this state.

I am offering xxxxxx an opportunity to settle this account. To date I have paid a total of $875 ona $300 payday loan with your company. $630 in interest/fees and $200 on the principal balance. Since Ohio law only allows a maxium of $55 to be charged on a $300 payday loan, I have been illegally charged $575 in interest and fees. I am expecting xxxxxx to mark the account paid in full and a refund of $475, the amount I have been overcharged.

All telephone communication to my home or place of employment are to cease and desist. All correspondence as of today shall be in written form through e-mail or written letter through the United States Postal Service.

I would like to thank you in advance for your prompt attention and cooperation in the matter. Also, please be advised that a formal complaint has been filed with the Ohio Attorney General's Office on August 30, 2006.

Amy, if I were a payday loan company and received this kind of letter from a customer, I would be forced to check the records and find out the truth. :) Go get them! You are doing absolutely right and you have proof of it. There shouldn????????t be a problem in posting your account as 'paid in full' after collecting so much of money from you.

Yes, I have read some payday loan companies refunded money of the borrowers who were charged excessively. Sonic, the worst has also marked the accounts 'paid in full'. This letter works especially when you are in the right side. Go get them, Amy... You have nothing to lose when you are exercising your legal rights. Good luck.
