Everyone -

My wife and I are so excited right now we can hardly believe it!!!!!

I verified this morning that my old bank account was closed as I instructed them yesterday. It was. Only my new account shows up.

That done, I just got done faxing to all my payday lenders the letters that I posted here the other day.

Within *MINUTES* of sending the faxes, I got a call from Gwen at Telmerica.

Gwen told me that she had marked my account *PAID IN FULL* and that she was passing my letter to her supervisor for resolution of the second part of the letter. (This was one of the letters where I told them I was due a refund.)

So... to those of you who are wondering if you can ever break out of the trap of PDL h----, take it from me.

You can do it!!!! Just follow the advice of the good folks on this board, take a deep breath, and GO FOR IT!!!

The only thing stopping you is YOU!!!

Rick

Way to go Rick. I'm keeping my fingers crossed too that one day I'll be able to get out of this pdl mess. Keep in touch.

Amy, Tiffany, and ChicagoBabe -

While I'm not out of this mess yet, I've definitely made progress with what I've done so far.

My suggestion to you is GO FOR IT!!! Don't wait until you have the letters perfect or you have every exact detail of your state's applicable laws. My letters were far from perfect and I spent waaaaaay too much time trying to get the exact details of the applicable laws.

(If you want, you're more than welcome to use my letters as templates. I posted them a couple of days ago.)

I finally decided that good enough was good enough and went with it. I did hafta wait a couple of days to make sure my account was closed before I sent the letters.

I didn't want the PDLs trying anything funny by forcing the debits through in case the account wasn't closed.

Tammy -

I agree. I think the PDLs don't like the fact that people are waking up to their loansharking ways. An educated consumer is *always* better than an un-educated one.

You are so right Rick. Alot of us have went up against these loan sharks and had our loans marked paid in full because of the laws they violated and not being licensed. I love the line they use that we have to go by there laws. They are totally wrong on that one. They have to go by the laws of the state the borrowers live in.

Rick,

I'm glad to hear the good news. It sounds like a step in the right direction. I too was in the pdl mess several months ago and started researching laws etc. I found that all of mine were not licensed in my state but mine were all internet lenders. I received refunds from a couple but I am happy to receive the paid in full status. I am still fighting a couple and it's unbelievable the excuses they come up with at times.

Rick, I had the same success with XPRESS Cash/DMS Marketing! My Ag's office is contacting each one and forwarding the complaints to the Div. of Fin. Inst. for further investigations. I already paid each company over $630 in interest on each loan, one wanted to settle a $300 loan for $600 after already receiving $630! That was before the AG's office starting contacting them, since I haven't heard anything. But I know I will not settle for $600.
