Need help with PDL's
Date: Sun, 09/10/2006 - 09:23
One of them Payday Avenue even sent a wage assignment to my employer, and placed several calls to them revealing my debt situation. I was livid that they did this, and explained to my payroll department what was going on. My employer told them that they would not take any funds out of my paycheck unless it was a court ordered document. I haven't heard from them since, but am expecting a call or some type of action any day now.
Another, Epayday had someone from Bass & Associates call me on Friday at work. The person on the phone was threatening to file fraud charges against me, and have me arrested at work. Not only that, but threatened to notify my employer and fine them as I had applied online while I was at work. The person is giving me until 2:00 CST on 9/11 to pay it in full or a substantial amount of $400 or they will file charges immediately. They are telling me I owe $775.00 when the original debt was only $300. They said they had done a background check on me, and because they firm that funds the Epayday loans is an FDIC backced company, fraud charges can be filed. They suggested that I hire an attorney, as I was going to need one. Can they really do this. I need some advice quickly on what to do, and what my rights are.
The companies that I have these through are as follows. Payday Avenue $1,000, Zip Cash $200, Route 66 $200, Epayday $300, ICS $200, One Click Cash $300, Cash Doctors $200, JD Marketing $200. Had already paid interest fees on all of these as well at least twice on each.
I want to pay these, but cannot pay all of these in full at the same time. With all of the interest fees I've paid in the past, its put me way behind on most of my other bills. Just need help in consolidating these into one monthly payment.
I live in Oklahoma and want to know immediately if this Bass & Associates firm can actually put me in jail for fraud for this. Any help you can provide will be greatly appreciated.

Read some more posts on the site. Many of us have been threatened with arrest, fraud, etc....But I know in my state you can not be arrested for defaulting on a payday loan, most states (if not all, I could be wrong) it is a civil matter. Try checking your state laws. Pollyandsay has a blog that has links to each state's law regarding payday loans.

I live in California and it states in our laws that defaulting on a PDL is not criminal, but civil and there is no way you can be arrested.
Did you sign any voluntary wage assignments with these people? If you did, you need to contact your payroll dept immediately and revoke them. You will also have to close your bank account and get a new one. It's the only way...
