Got a call...........

When I got this call I freaked out. While holding I did a quick on line search for Bass & Associates. She sounds so official it really is rather scary.
She just came back on and told me that I had to pay them 700.00 , 300.00 by 2pm TODAY or she was going hand over my case to the local court. She also mentioned about my husband being accountable as well. I started to cry and was not mean but there is no way I can come up with 300.00 by 2pm today.
I don't know what to do. Are ya'll SURE this is a collection agency and there is nothing they can do to me like they are saying?

They are nothing more than blowhards. Their threats are getting carried away. You will not be arrested. There is no debtors jail. File a complaint against them with the AG in Florida and in the complaint, be sure to give the name of the person you talked to, and the threats issued.

Use your legal rights on them. Why do you need to feel scared by their calls? If they are doing valid collections, they should give you information about your debt? Have they shown you anything on paper for what they are collecting? I guess not!! Use your rights and send them letter in writing for the validation of the debt. Without going through this first and foremost process when doing legitimate collections, these companies cannot do anything against you. Instead, by threatening you, they are violating the federal laws and you must file your complaints against them. You need to get more knowledge about debt collection practices in the FDCPA.

These types of collection agencies are being more careful about what they say to get you to pay. Awhile back they first made threats of arresting you. I'm sure some are still using that terminology. Rest assure, if they were going to pursue legal action, they would send a letter and not call you. Tell them to cease & desist telephone communication with you, and that you're consulting with your attorney. Any further communication needs to be done and writing, say "thank you, have a nice day", and hang up the phone before they can get any last words in.
In the meantime, what do you plan doing with the original debt? What state are you in? And what was the name of the loan company? Speak with the original lendor to find out who is suppose to be collecting on this. Get a letter typed up and send it to that collection agency for verification/validation of debt.

This is the favorite line that most illegal collectors are fond of using. If they can scare you on this, they get a chance to make some money even though your file is not with them. If the file is on collections and with disputed information, they will force on renewing the SOL by getting a small amount from you. So, be aware that collectors doing illegal things often want you to be trapped. Don????????t let them do it as long as you know what is right for you under the federal and state laws.

Ive seen many on this forum say you cant go to jail for a debt.This is false as my sister has been taken to jail for 2 different debts and the bail was the exact amount she owed.....if this isnt legal then why do places get away with it?
