I'm being sucked back in...
Date: Fri, 09/15/2006 - 14:08
I had a loan with a storefront lender, and after renewing the loan 5 times, it has to be paid in full the 6th time. You have a 7-day cooling off period before you can reloan. Anyway, I was unable to pay the full amount when the time came. I had just enrolled in a settlement program and was trying to get my all the pdls taken care of. I read that people on here have had success with getting storefronts to work with you on a payment plan if you are up front with them and let them know you want to honor your debt.
I went in to Advance America and was greeted cheerfully by the usual gang until I explained the situation. Of course the mood changed and I was scum. The manager told me she would hold my check for a few days, but advised me to borrow from someone to pay my Advance America loan off, then I would be eligible to get a loan at another lender because there would be no cooling off period elsewhere. Nice advice, eh?
I was unable to borrow the money and informed her in writing that as per my conversation with her, my bank account was overdrawn and frozen (which it was), and that I want to pay my loan off, will need to make 3 payments to do that. I gave her the dates I would make the payments and the amounts. I had no response. The next thing I know, she presents my check to my bank a few days before my next pay day and I incur even more overdraft charges. Certainly not the way to enable me to have more funds to pay her is it? I went in to the bank and said I wanted to stop payment on the check in case Advance America tried to present it again. The girl assured me that once it had been returned as NSF, the pdl could not resubmit it for payment. So stupid me believed her.
I got paid today and logged on to my account online. Lo and behold, I'm almost $400 short. I call the bank and they refer me to my local branch. This wench had gone in this morning at 9am sharp to my local branch and cashed the check!!! So the bank was full of it about the stop payment and now I'm screwed. I had allotted my earnings to go to certain debts and this has totally blown it.
So now, I have to go to another storefront pdl and take out a loan to recover what Advance America took. If I don't, that will only leave me $317 to last me until the end of the month. I have utility payments, childcare, gas, etc. that have to be paid. I do not want to take out another loan, but what am I supposed to do? I have no one (i.e., friends/family) who will lend me any money because they don't have it, and I have no available credit on my cards, as they are all in my settlemenet program. I am truly screwed. This is how people get sucked back in. Just when I think I'm pulling myself up, I get a foot in my face shoving me back down.

Tiffany,
First off, I and everyone else on this site can totally relate to this and my deepest sympathies. Did you get the name of the person at the bank who told you that you didn't need a stop payment?
I would call the bank back, explain that you didn't authorize it, you got bad information and you want your $400 back ASAP.
Advance America is one of the worst storefronts out there, as I know so well, and what you related is totally their MO.
As one who is in the same boat, I can tell you that more PDLs aren't the way to go. Hang in there!

Does your state support with any rule that once a company is returned NSF, they cannot resubmit for a payment. In which state do you live? I will check on the laws there.
kscornell has a point. You should talk with a supervisor in the bank for the wrong information given by their staff. Stick to it so that the bank reverts the charges added to it.

Please don't get discouraged, you will see a light at the end of the tunnel. I know you don't have much left out of your paycheck, try to make it last and if there's any way to pay a little on your bills now and the rest next paycheck, anything is worth trying to avoid another pdl it's just going to make things work. I think alot of us have been in the same situation and that's how we've ended up with more than one pdl, but at some point, we have alll decided enough is enough.
I meant to say pdl is just going to make things worse, not work.

Yes Tiffany, you also know very well how risky it will be taking a new payday loan especially when you are facing the bad consequences because of it. Don't lose hope. It's just the bad moments that are ruling over. Don't fall for it. Look for some part time jobs if that helps. I am so sorry to hear you.
Tiffany...Another PDL is just going to keep the cycle going.....
Tiffany...Another PDL is just going to keep the cycle going.....Is there any other options you can think of to get through the month? It's just another 2 weeks...I've made it through a whole month on $300 when I was coming through it...I ate a lot of ramen noodles, but I did it.
PM me if you need to talk, ok?
I live in Indiana, so no idea about re-presenting a check return
I live in Indiana, so no idea about re-presenting a check returned NSF. I did ask someone at the main call center for my bank about whether or not the check could be resubmitted after being returned NSF, and they said it could. So obviously the girl at the local branch was wrong. It's Fifth Third that I'm dealing with, and I seriously doubt they'll remedy anything.
I'm going to get through this and not succumb to being sucked in again. Although I'm totally screwed, at least Advance America are paid off and out of the way.
Thanks for all of the support....

That is one way to look at it, one down. I used to be with Fifth Third, and you're right they are not going to try and help. How many pdls does that leave now?
check into cash, ohio
i have to call these people today because when i spoke with her yesterday, she basically told me to borrow from another place to pay them. Not going to do that. any advice on how to handle them? i have already closed the account. I have two online and three storefronts, check into cash, america check mart, and cash connection.
don't ever borrow money that you cannot or will not pay back.
don't ever borrow money that you cannot or will not pay back. unfortunately, this was not an on-line payday loan and you knew what the pay back terms were. why should you be able to pay it back the way you think is right? i'm not trying to be a jerk, but you stated you knew what the rules were and i am surprised you think you are not responsible.

Guest - Most people, myself included, borrow with the intention of paying money back as agreed. If this was a perfect world, I wouldn't have needed to borrow from a payday lender in the first place. Most reputable lenders are reasonable when customers encounter a problem, and are willing to work with them to come to a mutually acceptable repayment arrangement. Even some of the worst online lenders are willing to accept payment arrangements when a customer cannot pay their loan back as originally agreed.
At the end of the day, if I had been able to come up with the full amount on the date it was due to be paid back, Advance America would have gotten their money, as they have every time I've borrowed in the past. It had nothing to do with repaying the way I thought was right.
Guest, It is hard to come to terms with the fact that you screwe
Guest, It is hard to come to terms with the fact that you screwed up, which is exactly what this person is doing here and now, sometimes you need non-judgemental advice which is not what you are dishing out. No one here would ever say DON'T pay back what you borrowed, and that is not the intention of anyone here. Please try to understand that making a payment plan is not the same as not paying at all, or perhaps you have not ever been in a situation where you just don't have enough to pay an entire balance in full and you just simply cannot understand.

Tiffany do what you can to not go get another loan. The only thing you are doing is hurting yourself. See if you can get the utility co., childcare, etc. to work with you so you don't have to get another loan. Good luck and keep us updated and keep your head up, it will get better.

Thanks! I don't want to make my situation any worse, so I'll do what I can to get by until my next payday. Thanks for the words of encouragement and support from "most" of you.

you can do it tiffany...there are lots of ways to cut corners if you just stop and think about what you can absolutely do without for a couple weeks. I've learned 1 thing about my kids and dinner, they really don't care what it is, when I'm real broke and doctoring up top ramen, I just tell them I'm trying a new receipe someone at work gave me. Sometimes they like it others, they just think I have weird co-workers. Now that I just have top ramen in the cupboard all the time, they ask for it, so that helps. Also another thing I think parents forget about is teaching their kids about money. Remember that it is ok to tell your kids no, we can't do ....(whatever they are asking) until I get paid again. I had to do this and my kids are actually thoughtful now when I say, we could do so and so or we could do this, what would you like to do? They give it some thought and make a wise decision instead of just assuming they will get both or everything.

i too suffered through two years in pdl hell. what i found out after it was all said and done is, although they may be illegal, i signed documents (in a cocaine haze) and promised to pay back 500% plus interest. that is the point i am trying to make. thats all. please do not be so quick to jump to conclusions about me. i'm clean now of drugs and pdl's.
