Hello, everyone. ONe of the counselor has refer me to Richard Brennan. So far, from all the comment that i've seen in here all negatives about him. I've just received all the documents that i need to sign and sent to him. I haven't done it yet. Does anyone here knows any good debt settlement company out there that deal with not just only credit card but only PaydayLoan??? Thanks guys.

If you don't have problems in discussing about your situation here, we will figure out if a settlement plan is the only option for you or a consolidation program will also help. You can feel comfortable here :) I found this forum very helpful to me and with the advice offered by everyone. I was able to see some direction when there was a situation I felt completely lost. Now, things have improved a lot on my side.

One of the counselor from consumer credit couseling has contacted me yesterday and she recomment me to go with debt settlement. She refers me to Law Offices of Richard Brennan. I've seen all the negative comments about him in here, i dont know whether should i look for another attorney or just go with him. I've received all the documents that i need to sign and mail back to him. If you guys know any good debt settlement program or any good attorney please let me know. Thanks.

I did not like the ranking chart because my company was not listed there. Why? I don't know. BBB has great ratings on them and I honestly think my company should be on this list and it wasn't.

I've been with American Liberty Financial for 2 years and I am very pleased with their program. Excellent BBB Report with the BBB in south east florida and they are members. I found no other complaints against them with the Attorney General or FTC. The fees are based on the amount they save you as opposed to everything up front or within 18 months like most and believe me, they are scams who charge everything up front or over the first 18 months. They get paid everything before they even start to settle. Think about it, a co. who charges a flat fee knows how much they are making. A co. who charges their fee on how much they save you not only will settle faster for you (less interest accrued)but if their pay check depends on service don;t you think they would do a better job for you? I had a friend who went with this type of program and they did nothing for her. They made up reason after reason why they were not settling and then finally one law suit after the next. Citibank is the worst. She had 2 citibank accounts and both of them sued her and garnished her paycheck. I have had nothing but success. I had a a $35,000.00 MBNA loan settled for $4500.00 within the first 6 months of my program and the co. even held off on my fees until I finished the settlement. They have already settled 72k worth of debt for me and I only have one account left to settle. I was never sued and I never felt like I was being over charged. I wish you all the best!

I am working with Superior Debt Services myself, I was contacted by them when I became a member of the forum back in December. After much research and questions to them, I signed up at the end of March. They have an excellent rating with the BBB and among their customers. They are a very professional and courteous company. All of my questions are answered promptly by my credit counselor and believe me there have been some oddball ones by me. They don't hide anything and everything is written in their contract. I've had no problems with them :)

Does anyone know if a settlement company such as SDS is bound by the terms of an agreement if none of their people sign the contract/agreement? I just noticed that I would have to sign and mail the enrollment package, which acts as the contract, but they don't sign and send it back. Don't contracts usually involve all parties signing? Or is their consent to the contents implied by the fact that they wrote the agreement in the first place?

They will put the contract like this that if a creditor insists in taking the matter to the court, the settlement company will not be held accountable for it. Your documents and the money deposited in the new account will prove your actions in front of the judge and willingness to pay the debt. The judge makes the decisions after considering these points. Before you sign up, get this point cleared with the consultant.

I'm not sure I explained my question well (or else I'm not following you PassionHunting). :) At this point I'm just asking about the agreement with the settlement company. They outline their responsibilities and mine and what I can expect, etc. I am required to sign this agreement, but they do not sign it as well. Are they legally bound to actually fulfill their responsibilities to me then? For example, SDS writes in the agreement that if they cannot obtain a settlement better than X%, they will refund my fees. But because they do not sign the agreement, are they legally bound to that? One person I talked to said that they are because the agreement is on their letterhead, which makes some sense, but...I'm understably very slow to trust right now. :/

You are assured that this point of getting the favorable deal for you is one of their terms and conditions and then get something signed by you so that the contract becomes valid. Anything if it is in writing must have a reason. You can use it to defend in case of possible dispute later.

I believe they would honor their obligations but it is something to think about. I have no doubts about them. I've asked them similiar questions and gotten very close replies. One time I was so worried that if I actually got sued by one of my creditors and they won, would Superior keep my fees for that? They said no...

If they are doing a good job, people need to know that, if they are not people need to know that as well. Please reconsider you position of not telling because you don't want to give them any free advertising. That is just silly.

I think I've opted to go with American Liberty Financial myself. Not because of my concerns about the contract (SDS seems like a great company), but rather because of the difference in their fee structure. After researching into settlement if I were to do it myself, and the tendencies of my credit companies, I concluded that paying any company a large fee up front as SDS requires would make it almost impossible for me to have enough money to settle with my creditors before they would sue. For my situation, a settlement company with only a small retainer fee that takes their payment after the settlement, based on how much they saved me, is crucial to success. I'd be in for a world of hurt otherwise. :)

Hmmm, when I spoke with American Liberty, they told me the 1st 3 months of my total payment would be going to their fees! I still think they are a good company. I went with SDS as they had a lower monthly payment amount which better fit my budget. No sense paying to a company if I can't afford it. Also, SDS payment also included a dept store credit card that American's amt didn"t.

American Liberty called me back after I signed with SDS. They wanted to make sure I wasn't signing with a bad company. I didn't tell them who I signed with. When he asked how long the company had been in business I told him 7 yrs. He said wait a minute, came back & said he talked to his big boss & the boss said that no company has been around longer than 4 yrs. If you look at the bbb site for SDS it shows they started in 1998! I know American was just trying to get my business, but none of the other companies tried to bad mouth each other, they were just glad I was getting help

after reading a reply on here i also contacted American Liberty. the person i talked to was less than impressive and something did not sit right with me. when i received the email with the price breakdown i was surprised to see the initial payments which were not explained to me at the time.
i signed yesterday with another debt settlement co. - solve debts. so hopefully i made the right choice to financial freedom instead of neverending credit card debt.

Well, that's why there are different companies to choose from. We are able to choose the one that best fit our needs. I started with debt settlement after I settled my mess with internet pdl's. I couldn't afford both payments at the time. To be honest, I was still skeptical about debt settlement. I thought Superior was the right choice for me once I knew the payment I could afford. I started out on 24 month program but was able to shorten it to 18 months instead. So, a year to being debt free for me. Good luck to both of you :)

In reading you posts here and over at debt info center, I just wanted to give you a friendly beware. I found the other forum to be kind of "shady" after I asked them for additional information about their company. They banned me and DELETED my posts from their forum.
First of all, I read Sifxpert's comments to you about Superior Debt and how he back tracked from talking good about them and then started talking negative about them. He mentions to you about the company taking an up chunk fee and milking you for 18 months. He blows this way out of normal thinking view and I also noticed many incorrect spelling of words, which I found that odd behavior coming from someone with such a "high status profile".
Needless to say, the important thing to consider is this: When you chose your company, be sure to investigate their status with BBB, ask questions, get it all on paper, investigate, do your homework!! Don't just give your money, bank acct information, credit card information to any joe blow on a forum somewhere. Get it all in writing and make sure it is not a fly by night company.
I am with a debt settlement company and they took 250.00 out of my 400.00 dollar payment for the first 3 months. For the remaining 15 months, they take out only 176.00 of the 400.00 monthly payment. 15 months out of a 36 month program is not bad. Why would they quit helping you after they had all their fees within 15 months? They do not want you to drop out of their program and they sure don't want you reporting them to the BBB. How would BAD business make them future business.???
I asked these questions over on the other forum and was banned for it. You can put two and two together and come to a conclusion.
