Calling Parents and other desperate help needed

I have a few (4 - 7) cc accounts that have charged off since my wife had some medical problems, and we did not have insurance. That was almost a year ago. The total dollars are about $65,000. I read in the old Art of Credit pages to not deal with the vermon level CA that now have bought my debt for pennies on the dollar and hold them now. Was that the right thing to do? I do not know now.

If I should start paying on this, what is my best recourse? Consolidators have the high fees.

Also, they are calling my parents about once every 2 -3 months, but twice this week end and. They are ill and dont need to be put through this.

While I was typing this (I have statred answering all calls to get the heat off my parents), NES called threatening a suit if I don't pay them by Thursday (over $16,000) on an old MBNA debt. Are they for real? What should I do?


The first thing I would do is send debt validation letters to all of them You want to make sure they are not out of the SOL period.Paying anything on them will start the clock on them all over. All of them can,and will,threaten any and everything,jail,lawsuits,etc. Some will do judgements and garnishments. Get you letters off ASAP and also send a cease and desist,that all communication be done by mail. If they are giving others info about your debts,they are breaking fdcpa reg.In the debt validation letters,they will have to prove they legally can collect,prove it isn't out of the SOl period along with other things.If you join the forum,you will receive free credit counseling,where a professional can talk with you and tell you what options,such as consolidation,you may have. At this point, your accounts are already in default and the creditors or the collectors might take legal actions anytime if they don't receive money. So, you need some professional help from the consultant and know about your options. Don't pay money to the collectors unless you figure out that they are doing the collections with genuine reasons and they have your file. They must give the complete info in writing.

Consolidation programs are not costly. You will save good amount of money after the program finishes. Besides, all these legal threats will also get dumped at the backyard after your accounts start getting paid off.

If you are going to go with a debt consolidation company that sends out dispursements you need to make sure you want to make low dollar payments for the next several years and get an accepted proposal for each and every creditor.

You need to validate each debt with each collection agency along with sending a C&D letter to your parents number. Find out which accounts have been purchased or not. The ones that have been purchased will often let you settle for around 20-30% on high balances, send them a letter.

As for funds. Are you currently employed? If so see f your employer will buy back your vacation time. Cut off your cell phone for a few months if your contract allows, that can sometimes lead up to an extra 50-70 dollars a month. Do you have a 401k? Life insurance, you can smetimes cash in a policy early depending on how lon you have had it. Relatives can either cosign a loan or outright loan you money and act as a creditor. How long have you been with your bank? Do you own a home that has equity or can you refinance your mortage? Are you 65+ years of age, you can apply for a reverse mortage, you can also defer a home payment. Have a garage sale of sell things on EBay or go sell things at a pawn shop you have no use for. Can you defer an auto payment? Do you have any credit card stil in good standing, you can get a cash advance or even defer a payment to a credit card as well.

And if you choose verbal contact, I would suggest not treating collectors like "vermon" until they start to treat you like that because not all collectors are from the spawn of satan.
