Cast today Ltd. continuing to ignore my e-mail's have been trying to reach them by phone - always on hold
now they say they have turned this over to there legal department - I have sent them letters after letters stating my state laws how I have paid them well above the 200.00 how there fees are in excess of the state of Arizona usary laws etc. etc. and they continue to ignore - They are not calling my work or my cell phone they are just sending me e-mails
any Advice????????


They did the same thing to me, they're just blowing smoke. They CAN NOT do anything, because they're not licensed. (Even thought they told me they are registered in all FIFTY-TWO United States...I said, "52? I was told in Geography class that there are only 50!")

If they try to take you to court, which they would HAVE to do in your local court, they could be arrested for loaning money without a license.

Hi ouzog12: I had the same issues with this place..and Jessi is right..they cannot take you to court..here is what I wrote to them, and their response...Darren is the manager..feel free to use my templete if needed:

It has come to my attention that you are operating in violation of Maryland
State Administrative codes governing Check Cashiers/Sellers and Payday
Lenders wherein it states that Payday Lenders are required to be licensed by

the State of Maryland. This law applies to any payday loans made to
Maryland state residents regardless of the state of origin or contractual
jurisdiction agreements.

Irrespective of our contract, you appear to be conducting business in
violation of this administrative code and the governing law directing its
creation. This violation renders our contract illegal in the State of
Maryland, rendering any terms agreed to therein null and void.

In order to settle my account and avoid any liability, I may have by being
party to an illegal transaction, I m willing to accept settlement of my
account for the principle balance only to be paid in equal monthly
installments of $100. These installments will be paid using certified,
traceable funds in the form of Cashier's Check OR Money Order only.

On advice of counsel, I am hereby immediately revoking my previous
authorization for ACH/Electronic withdrawal due to the fact that the loan
was made in violation of Maryland State Law.

A copy of this email is also being forwarded to my legal counsel.

I will expect a reply within 48 hours, or I will be forced to escalate my
efforts to resolve this issue.

So far, I have not read anyone saying that Cash Today has actually sued anyone in the US. The situation that you find yourself in is happening with many others. If the company had done something beyond this like taking someone to the court, I am sure it would have been posted here. But it didn't. So, what's the conclusion you draw from here?

Yes, I have read few posts that say about being sued by the lenders. But that happens only when the lenders have the legitimate reasons or their debt consolidation/settlement company had been not been making the payments. Their has to be enough reasons to get a case. It cannot be done by weak reasons and threats often put by the lenders.

Well, I don't say that every storefront lender is following the laws and have grounds to get a case against the consumer. At the same time, I will not say that every internet lender is violating the laws. This is a big industry and we are only talking about a fraction of them. but they are very much talked about because of their nature of business.

I remember a situation last spring..If I remember correctly, the internet company sent the loan to a ca that WAS licensed, and the CA was able to actually get a judgement to garnish. I remember this, because I was helping the person with the garnishment..I don't know what ever happened with that, though. And..I'm almost positive the company was sonic.

Sounds like it. That's a tough lesson. I know getting your paycheck garnished isn't fun. Mine was for 2 paychecks for student loans, I'm paying on them now through my chpt. 13. (They garnished 10% of my take home pay) But I did have warning they were going to do it, I didn't argue, I was going through hard times, I had to choose between medications for my children or pay that bill, and believe it or not the garnishment was way lower than what the payment was, drawback is it's on the credit report as in default. Now it shows as being paid on through chpt. 13 wage payment plan.

It's weird, a lot of times garnishments are lower than the payments. When I get a writ on someone at work, I wait the maximum 28 days before I file it. I don't think most HR reps do this, but I remember too well what debt is like. If I give them the max time before I start deductions, they have time to plan or file a tort. You would not believe it, tho..A lot of people blame me for their garnishments.

You're just doing your job. I can't wait, my chpt. 13 is almost up! After reading some of these post, I see that some snakes try to come back and collect on the ones that were discharged in the bankruptcy due to not filing a claim. I won't worry now when or if they try this, thanks to this site I am prepared. (I may be disappointed if at least one doesn't try this with me)lol. I'm getting excited about having control of my entire paycheck after 4 years and NO DEBT.

Yes I am! I really didn't have a choice, my son had racked up $200,000 in medical bills (that was after insurance paid its fair share), then the kicker is this, after I filed, he got his waiver which allowed him to get Medicaid despite my income. (He had been on this MR/DD waiting list for this for more than 12 years) You see the news stories that the elderly are forced to choose between food and their meds, well I was in this situation with both of my kids, I would literally go without meals so there would be enough for them to last til next payday so that I could pay my share of the meds. I felt like we won the Mega Lottery when I got the letter his name came up on the waiting list.

I think you need to do what I was forced to do with these nuts--and that is threaten to file a police report. Once I got the info and told them I was prepared to do that, my file was suddenly marked paid in full. They are shady and illegal and totally insane, I might add--and will make you that way, due to calling you 3000 times a minute!!
